RESOLUTION 77A-16 <br /> RESOLUTION DECLARING THE INTENTION TO UPDATE THE NON- <br /> RESIDENTIAL SEWER ALLOCATION FEE SCHEDULE, SETTING A PUBLIC <br /> HEARING AND DIRECTING STAFF TO MAIL NOTICES TO NON-RESIDENTIAL <br /> SEWER USERS <br /> WHEREAS, the Town of Los Altos Hills ("Town") provides sanitary sewer services to <br /> approximately 14 non-residential users, including Town facilities; and <br /> WHEREAS,the Town of Los Altos Hills Municipal Code Sections 6-4.445 and 6-4.445(1) states <br /> that all sewer users shall pay a sewer service charge and the charge will be determined based on <br /> "service unit" compared to a typical single-family residence; and <br /> WHEREAS, the Town currently uses the 2003 Sewer Allocation Fee Schedule which assigns <br /> units of service consistent with the equivalent units of services used by the City of Los Altos at <br /> that time; and <br /> WHEREAS, the actual basis for how the City of Los Altos derived those units of service is <br /> unknown; and <br /> WHEREAS, an evaluation of non-residential wastewater discharge study was prepared to <br /> establishment a defensible methodology to support the equivalent units of service allocated to non- <br /> residential users; and <br /> WHEREAS,the City Council intends to consider the proposed Non-residential Sewer Allocation <br /> Fee Schedule, attached as Appendix A, by following procedures required under Article XIIID, <br /> section 6 of the California Constitution. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills <br /> that: <br /> 1. The City Council hereby fixes the 20th day of January, 2017 at 7:00 p.m., in the Council <br /> Chambers, 26379 Fremont Road, Los Altos Hills, California as the time and place for a <br /> public hearing (Public Hearing) on the proposed Non-residential Sewer Allocation Fee <br /> Schedule. <br /> 2. At the time of the Public Hearing the City Council will hear and consider protests and <br /> objections from the non-residential sewer users to the proposed Non-residential Sewer <br /> Allocation Fee Schedule, and any the non-residential sewer users shall be permitted to <br /> present written or oral testimony. Although oral comments at the Public Hearing will not <br /> qualify as a formal protest,the City Council welcomes community input during the Public <br /> Hearing. <br /> Resolution 77A-16 Page I <br />
