ORDINANCE 569 ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING TITLE 10, CHAPTER 2,ARTICLE 4, OF THE LOS ALTOS HILLS MUNICIPAL CODE, REGARDING RESTRICTIONS DURING THE WET SEASON WHEREAS, the Town of Los Altos Hills wishes to amend the Municipal Code with regards to the rainy season (wet season) of the grading ordinance. NOW,THEREFORE,the City Council of the Town of Los Altos Hills does hereby ORDAIN as follows: SECTION I. AMENDMENT Title 10, Chapter 2 ("Site Development") of the Los Altos Hills Municipal Code shall be amended as follows: Article 4. Grading 10-2.404 Restrictions during wet season. The City Engineer shall restrict grading operations during the wet season. The wet season is defined as the period between October 1st and April 30th. The City Engineer may allow grading to proceed during the wet season if precipitation has been minimal; if the grading technique to be used will minimize the risk of landslides, erosion, or damage to adjacent properties or environmentally sensitive areas from soil movement; or if it is in the interest of public health and safety to permit grading. Following any twenty-four (24) hour period during the year in which one-half inch or more of rain has fallen the City Engineer may prohibit grading. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does hereby further ORDAIN as follows: 1. Severability. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other persons 9r circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this ordinance are severable. The City Council of the Town of Los Altos Hills hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable. 2. Effective Date; Publication: This ordinance shall take effect thirty (30) days after adoption. Within fifteen days after the passage of this ordinance the City Clerkshall cause this ordinance or a summary thereof to be published once, with the names of those City Ordinance 569 Page 1
