ORDINANCE NO. 413 AN ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING SECTION io-1.2o.8OF THE LOS ALTOS HILLS. MUNICIPAL CODE REGARDING THE DEFINITION OF BASEMENT WHEREAS, the City Council, of the Town of Los Altos Hills ("Town") wishes to amend and clarify the.definition of"Basement' in the Zoning Ordinance. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: 1. AMENDMENT OF CODE. Section 10=1.208 (Basement) of Article 2 (Definitions) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the Municipal Code of the Town of Los Altos Hills is hereby replaced in its entirety.to-read as follows: "Basement" shall mean a floor level directly under a building which is wholly underground on.at least 3 sides,or at least 75% of its perimeter length and having its entire height measured from its floor to its ceiling below the adjoining grade. That side of the basement not wholly underground shall not be located on any side of a lot abutting one side of a road. Basements, including cellars and bunkers,which are not located within the footprint of the building above, may be permitted bythe Planning Commission when itfinds that such structures do not encroach in setbacks, are a minimum of 18 inches below natural grade, are wholly underground except for required exiting, lighting and ventilation and are counted as development area except when placed. under a-surface. already counted as development area." 2. ENVIRONMENTAL REVIEW. Pursuant to CEQA, the City hereby adopts a negative.declaration for this project,.having determined the adoption of this ordinance will not have a significant effect on the environment 3. EFFECTIVE DATE: POSTING. This ordinance shall become effective thirty (30) days from the date of its passage, and shall be posted within the Town of Los Altos Hills in three (3) public places.
