ORDINANCE NO. 413 <br /> AN ORDINANCE OF THE CITY COUNCIL OF <br /> THE TOWN OF LOS ALTOS HILLS AMENDING <br /> SECTION io-1.2o.8OF THE LOS ALTOS HILLS. <br /> MUNICIPAL CODE REGARDING THE DEFINITION OF BASEMENT <br /> WHEREAS, the City Council, of the Town of Los Altos Hills ("Town") wishes to <br /> amend and clarify the.definition of"Basement' in the Zoning Ordinance. <br /> NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN <br /> as follows: <br /> 1. AMENDMENT OF CODE. Section 10=1.208 (Basement) of Article 2 <br /> (Definitions) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the <br /> Municipal Code of the Town of Los Altos Hills is hereby replaced in its entirety.to-read as <br /> follows: <br /> "Basement" shall mean a floor level directly under a building which is wholly <br /> underground on.at least 3 sides,or at least 75% of its perimeter length and having its entire <br /> height measured from its floor to its ceiling below the adjoining grade. That side of the <br /> basement not wholly underground shall not be located on any side of a lot abutting one <br /> side of a road. Basements, including cellars and bunkers,which are not located within the <br /> footprint of the building above, may be permitted bythe Planning Commission when itfinds <br /> that such structures do not encroach in setbacks, are a minimum of 18 inches below <br /> natural grade, are wholly underground except for required exiting, lighting and ventilation <br /> and are counted as development area except when placed. under a-surface. already <br /> counted as development area." <br /> 2. ENVIRONMENTAL REVIEW. Pursuant to CEQA, the City hereby adopts a <br /> negative.declaration for this project,.having determined the adoption of this ordinance will <br /> not have a significant effect on the environment <br /> 3. EFFECTIVE DATE: POSTING.
