flood, storm, epidemic, riot, drought, acts of terrorism, sudden and severe energy
<br /> shortage, plant or animal infestation or disease, the Governor's warning of an
<br /> earthquake or volcanic prediction, or earthquake or other conditions which are, or are
<br /> likely to be, beyond the control of the services, personnel, equipment and facilities of the
<br /> Town and require the combined forces of other public agencies to combat, or with
<br /> respect to regulated energy utilities, a sudden and severe energy shortage which
<br /> requires extraordinary measure beyond the authority vested in the California Public
<br /> Utilities Commission. "Local emergency" does not include, nor does any provision of
<br /> this Chapter apply to any conditions resulting from a labor controversy.
<br /> (d) "Plan" means the Town's emergency plan for response to an
<br /> Emergency which shall incorporate the Standard Emergency Management System
<br /> ("SEMS"). This Plan shall be effective upon the filing of the Plan with, and the
<br /> acceptance thereof by, the City Council, all as more particularly set forth in 4.1-05
<br /> (Emergency Preparedness Committee; Duties), below. The Plan shall provide
<br /> operational concepts relating to various emergency situations, identify components of
<br /> the Town area and county emergency management organization and describe the
<br /> overall responsibilities of the Town for protecting life and property. The Plan shall also
<br /> identify the sources of outside support which might be provided (through mutual aid and
<br /> specific statutory authorities) by other jurisdictions, state and federal agencies, and the
<br /> private sector.
<br /> (e) "State of Emergency" means the duly proclaimed existence
<br /> of conditions of disaster or of extreme peril to the safety of persons and property within
<br /> the State caused by such conditions as air pollution, fire, flood, storm, epidemic, riot,
<br /> drought, acts of terrorism, sudden and severe energy shortage, plant or animal
<br /> infestation or disease, the Governor's warning of an earthquake or volcanic prediction,
<br /> or earthquake or other conditions, which conditions, by reason of their magnitude, are,
<br /> or are likely to be, beyond the control of the services, personnel, equipment and
<br /> facilities of any single county, city and county, or city, and require the combined forces
<br /> of a mutual aid region or regions to combat, or with respect to regulated energy utilities,
<br /> a sudden and severe energy shortage which requires extraordinary measure beyond
<br /> the authority vested in the California Public Utilities Commission. "State of Emergency"
<br /> does not include, nor does any provision of this Chapter apply to, any conditions
<br /> resulting form a labor controversy or conditions causing a "State of War Emergency."
<br /> (f) "State of War Emergency" means the condition which exists
<br /> immediately, with or without a proclamation thereof by the Governor, whenever this
<br /> State or nation is attacked by an enemy of the United States, or upon receipt by a state
<br /> of a warning from the federal government indicating that such .an enemy attack is
<br /> probable or imminent
<br /> Sec. 4-1.03 Director of Emergency Services; Declaration of Local
<br /> Emergency .
<br /> (a) The City Manager shall be the Director of Emergency
<br /> Services. The Planning Director shall hold the office of Assistant Director of Emergency
<br /> Services. In the event the Planning Director is unavailable to serve, the Mayor shall
<br /> serve as the acting Director of Emergency Services. In the event of the absence or
<br /> inability of the Mayor to act, the following persons shall serve as acting Director of
<br /> Emergency Services in successive order: the Mayor Pro Tem, the most recent past
<br /> Mayor, the remaining councilmembers in order of seniority. The Director of Emergency
