C <br /> L <br /> ORDINANCE NO. 347 <br /> AN URGENCY INTERIM ORDINANCE OF <br /> THE CITY COUNCIL OF <br /> THE TOWN OF LOS ALTOS HILLS <br /> AMENDING CHAPTER 2 (SITE DEVELOPMENT) OF <br /> TITLE 10 (ZONING AND SITE DEVELOPMENT) <br /> WITH REGARD TO SITE DEVELOPMENT REVIEW OF RESIDENCES <br /> WHEREAS, Government Code Section 65858 allows a city, <br /> without following the procedures otherwise required prior to the <br /> adoption of a zoning ordinance, to adopt, as an urgency measure, <br /> an interim ordinance prohibiting any uses which may be in <br /> conflict with a zoning proposal which the legislative body is <br /> considering; and <br /> WHEREAS, Los Altos Hills Municipal Code Section <br /> 10-2 .301(b) (1) requires a site development permit for the <br /> construction of a principal or secondary residence; and <br /> WHEREAS, the City Council interprets this section broadly to <br /> mean that any primary or secondary dwelling use requires a site <br /> development permit; and <br /> WHEREAS, the City Council has adopted an ordinance to amend <br /> the Municipal Code to clarify that a site development permit is <br /> needed for the construction of a principal or secondary residence <br /> or the commencement of a principal or secondary dwelling use in <br /> an existing structure; and <br /> WHEREAS, before such ordinance take effect, the City <br /> Council, in order to prevent uses in conflict with such ordinance <br /> and in order to protect the public health, safety, and welfare, <br /> adopts this urgency ordinance so that no dwelling uses may be <br /> commenced without a site development permit; <br /> NOW, THEREFORE, the City Council of the Town of Los Altos <br /> hills does ORDAIN as follows: <br /> Section 1. Interim Ordinance. Section 10-2.301(b) (1) of <br /> Chapter 2 (Site Development) of Title 10 (Zoning and Site <br /> Development) of the Los Altos Hills Municipal Code is hereby <br /> amended, during the term of this interim urgency ordinance, to <br /> read as follows: <br /> 11 (1) The construction of a principal or secondary <br /> residence or the commencement of a principal or <br /> secondary dwelling use in an existing structure.
