ORDINANCE NO. 580 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS FURTHER AMENDING THE LOS ALTOS HILLS MUNICIPAL CODE BY AMENDING SECTION 2-4.03, CONCERNING OPEN .MARKET ORDERS 1. NOW THEREFORE, The City Council of the Town of Los Altos Hills does ordain as follows: SECTION 1. AMENDMENT OF CODE Section 2-4.03 entitled "Open Market Orders" of Chapter 4 (Purchasing System) of Title 2 (Administration) is hereby amended to read as follows: Section 2-4.03. Open Market Orders All purchases of professional and facility services, supplies, materials, equipment, or other personal property, the cost of which is less than Twenty -Five Thousand and no/100ths ($25,000) Dollars, may be made in the open market without newspaper advertisement. When deemed appropriate by the City Manager, open market purchases shall be based on at least three (3) competitive bids and shall be awarded on the basis of the bid most advantageous to the Town. The City Manager may solicit bids by the direct mail request to prospective vendors or by telephone. The City Manager shall keep a record of all open market orders and bids submitted thereon which shall be Open to public inspection. Notwithstanding the provisions of this section, purchase of Public Works as defined in the California Public Contracts Code shall comply with all applicable provisions of the Public Contracts Code. 2. SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this Ordinance, including the application of such part or provision to other persons or circumstances shall not be - affected thereby and shall continue in full force and effect. To this- end, provisions of this Ordinance are severable. The City Council of the Town of Los Altos Hills hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be. held unconstitutional, invalid, or unenforceable. 3. EFFECTIVE DATE AND PUBLICATION. This ordinance shall become effective thirty (30) days from the date of its passage. Within 15 days after its passage, this ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the Los Altos Town Crier, a newspaper of general circulation in the Town of Los Altos Hills, as required by law.
