ORDINANCE NO. 580 <br />AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS FURTHER AMENDING <br />THE LOS ALTOS HILLS MUNICIPAL CODE BY AMENDING SECTION 2-4.03, <br />CONCERNING OPEN .MARKET ORDERS <br />1. NOW THEREFORE, The City Council of the Town of Los Altos Hills does ordain as <br />follows: <br />SECTION 1. AMENDMENT OF CODE <br />Section 2-4.03 entitled "Open Market Orders" of Chapter 4 (Purchasing System) of Title 2 <br />(Administration) is hereby amended to read as follows: <br />Section 2-4.03. Open Market Orders <br />All purchases of professional and facility services, supplies, materials, equipment, or other <br />personal property, the cost of which is less than Twenty -Five Thousand and no/100ths ($25,000) <br />Dollars, may be made in the open market without newspaper advertisement. When deemed <br />appropriate by the City Manager, open market purchases shall be based on at least three (3) <br />competitive bids and shall be awarded on the basis of the bid most advantageous to the Town. The <br />City Manager may solicit bids by the direct mail request to prospective vendors or by telephone. <br />The City Manager shall keep a record of all open market orders and bids submitted thereon which <br />shall be Open to public inspection. Notwithstanding the provisions of this section, purchase of <br />Public Works as defined in the California Public Contracts Code shall comply with all applicable <br />provisions of the Public Contracts Code. <br />2. SEVERABILITY. If any provision of this Ordinance or the application thereof to any <br />person or circumstance is held invalid or unconstitutional, the remainder of this Ordinance, <br />including the application of such part or provision to other persons or circumstances shall not be <br />- affected thereby and shall continue in full force and effect. To this- end, provisions of this <br />Ordinance are severable. The City Council of the Town of Los Altos Hills hereby declares that it <br />would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase <br />hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, <br />sentences, clauses, or phrases be. held unconstitutional, invalid, or unenforceable. <br />3. EFFECTIVE DATE AND PUBLICATION. This ordinance shall become effective <br />thirty (30) days from the date of its passage. Within 15 days after its passage, this ordinance shall <br />be published once, with the names of those City Councilmembers voting for or against it, in the <br />Los Altos Town Crier, a newspaper of general circulation in the Town of Los Altos Hills, as <br />required by law. <br />INTRODUCED: January 18, 2019 <br />PASSED: February 21, 2019 <br />Ordinance 580 Page 1 <br />
