RESOLUTION 10-21 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS APPROVING AN APPLICATION FOR THE WILD PLUM LANE SANITARY SEWER MAIN EXTENSION IMPROVEMENT PROJECT WITH A FUTURE SEWER REIMBURSEMENT AGREEMENT PROPOSAL WHEREAS, pursuant to Los Altos Hills Municipal Code Section 6-4.501 through 6-4.504, entitled "Sewer Improvement Reimbursement", a property owner may install a public sewer improvement for the property owner's benefit, as well as the benefit of future users, and the Town will enter into a reimbursement agreement with the property owner for the reimbursement of the direct cost of construction collected from future users that directly benefit from that construction, subject to approval by the Los Altos Hills City Council; WHEREAS, an application for such sanitary sewer main improvement project may be submitted to and be reviewed by the City Engineer for recommendation to the City Council, and to be approved by the Council; and WHEREAS, the Town of Los Altos Hills received an application from the property owner at 14210 Wild Plum Lane for the Wild Plum Lane Sanitary Sewer Main Extension Improvement Project with a proposal to execute a reimbursement agreement with the Town upon completion of the improvement project; WHEREAS, the City Engineer has reviewed the application and plans for the project, and recommends that the Council approve the application for the proposed sewer improvements and the future users' list to be subject to a future sewer improvement reimbursement agreement; and WHEREAS, the construction inspection and test services for this project will be conducted by third -party agencies and Town Public Works staff will provide construction oversight; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the Town of Los Altos Hills does hereby: 1. Approve the sewer improvement application as reviewed and recommended by the City Engineer for the Wild Plum Lane Sanitary Sewer Main Extension Improvement Project. 2. Approve the proposed future users' list that would be subject to a sewer improvement reimbursement agreement as approved by the City Council after completion of the project. The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los Altos Hills at a regular meeting held on the 18t1i day of February 2021 by the following vote: AYES: Tanka, Tyson, Mak, Schmidt, Swan NOES: None ABSTAIN: None Resolution 10-21 Page I
