RESOLUTION 04-22 <br />RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS <br />SUMMARILY VACATING THE PATHWAY EASEMENTS <br />(Lands of Byrne LLC) <br />WHEREAS, Chapter 4 of the Public Streets, Highways and Service Easement Vacation Law, <br />commencing with Streets and Highway Code Section 8333, provides for summary vacation of <br />streets and public service easements; and <br />WHEREAS, pursuant to the provisions of Section 8330 et seq., of the Streets and Highways <br />Code, the City Council of the Town of Los Altos Hills seek to summarily vacate the Existing <br />Easements; and <br />WHEREAS, there are no public facilities in use or affected on the Existing Easements; and the <br />City Council intends to summarily vacate the pathway easement described and shown in Exhibit <br />"A" that is located within the property of 27290 Byrne Park Lane (the sanitary sewer easement <br />will remain as is.) <br />NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as <br />follows: <br />1. The foregoing recitals are true, correct, and incorporated herein by reference. <br />2. The Existing Easements described above and in Attachment 1 are hereby <br />summarily vacated pursuant to Chapter 4 of Division 9, Part 3 of the <br />California Streets and Highways Code, concerning summary vacation of <br />easements. <br />3. The City Cleric is directed to cause a certified copy of this resolution, attested <br />by the Cleric under seal, to be recorded in the office of the County Recorder of <br />the County of Santa Clara. <br />4. From and after the date of this resolution is recorded, the Existing Easements <br />shall no longer constitute as public service easements. <br />The above and foregoing Resolution was passed and adopted by the City Council of the Town of <br />Los Altos Hills at a regular meeting held on 20th of January 2022 by the following vote: <br />AYES: Tyson, Swan, Mok, Schmidt, Tankha <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution 04-22 Page 1 <br />
