EIR are applicable to the Town's enactment of this Ordinance. Moreover, none of the <br />conditions requiring a subsequent or supplemental EIR, as described in Public Resources <br />Code Section 21166 and California Environmental Quality Act (CEQA) Guidelines Sections <br />15162 and 151.63, have occurred. The EIR therefore adequately analyzes any potential <br />environmental effects of the Ordinance and no additional environmental review is required. <br />On a separate and independent basis, the Ordinance is exempt from CEQA pursuant to <br />Section 1.5308, Class 8 of the CEQA Guidelines of as an action that will not have a significant <br />impact on the environment and as an action taken by a regulatory agency for the protection <br />of the environment, specifically, for the protection of the climate. There are no unusual <br />circumstances that would cause this Ordinance to have a significant effect on the <br />environment. <br />SECTION II. AMENDMENT. <br />A new Chapter 8, entitled "Mandatory Organic Waste Disposal Reduction" is hereby added <br />to Title 6 of the Los Altos Hills Municipal Code to read as set forth in Exhibit A to this Ordinance, <br />which is hereby incorporated as though set forth in full herein. <br />SECTION III. SEVERABILITY. <br />If any provision of this ordinance or the application thereof to any person or circumstance is <br />held invalid or unconstitutional the remainder of this ordinance, including the application of such <br />part or provision to other persons or circumstances shall not be affected thereby and shall continue <br />in full force and effect. To this end, provisions of this ordinance are severable. The City Council of <br />the Town of Los Altos Hills hereby declares that it would have passed each section, subsection, <br />subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or <br />more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held <br />unconstitutional, invalid, or unenforceable. <br />SECTION IV. EFFECTIVE DATE AND PUBLICATION. <br />This ordinance shall be effective upon thirty (30) days from its date of adoption. Within <br />fifteen days after the passage of this ordinance, the Town Cleric shall cause this ordinance or a <br />summary thereof to be published once, with the names of those Town Councilmembers voting for <br />or against it in a newspaper of general circulation in the Town of Los Altos Hills, as required by law. <br />INTRODUCED: January 20, 2022 <br />PASSED: February 17, 2022 <br />AYES: Mayor Tyson, Vice Mayor Swan, Councilmember Mok, Councilmember <br />Schmidt, Councilmember Tankha <br />NOES: None <br />ABSTENTIONS: None <br />ABSENT: None <br />Ordinance 600 Page 2 <br />
