RESOLUTION 48-22 <br />RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS <br />DENYING AN APPEAL OF THE PLANNING COMMISSION'S DECISION TO <br />APPROVE A ZONING PERMIT FOR NEW FENCING AT 28001 ELENA ROAD AND <br />IMPOSE CERTAIN CONDITIONS OF APPROVAL <br />WHEREAS, The Town of Los Altos Hills received an application for a Zoning Permit (ZP21- <br />0047) from Sea Landing LP ("Applicant") for new fencing at 28001 Elena Road ("Project"); and <br />WHEREAS, based on the record presented before it, the Project is exempt from the provisions of <br />the California Environmental Quality Act (CEQA) pursuant to Section 15303(e) since the project <br />involves new fencing; and <br />WHEREAS, the Project application was processed in accordance with the applicable provisions <br />of the California Government Code and the Los Altos Hills Municipal Code; and <br />WHEREAS, the Site Development Committee held a duly noticed public hearing on the Project <br />on July 6, 2021 and considered all written documentation and public comments and remanded the <br />project to the Planning Commission; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on <br />August 5, 2021 and considered all written documentation and public comments and continued the <br />Project to a date uncertain; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on <br />October 7, 2021 and considered all written documentation and public comments and continued the <br />Project to a date uncertain; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on <br />January 13, 2022 and considered all written documentation and public comments and continued <br />the Project to a date uncertain; and <br />WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on March <br />3, 2022 and considered all written documentation and public comments; and <br />WHEREAS, the Planning Commission voted 5-0 to adopt the resolution to approve the Zoning <br />Permit for the proposed fence at 28001 Elena Road with conditions; and <br />WHEREAS, on March 14, 2022, the Applicant submitted a Notice of Appeal to the City Cleric to <br />appeal the Planning Commission's conditions of approval to the City Council; and <br />WHEREAS, the City Council held a duly noticed public hearing to consider the appeal on April <br />21, 2022, and considered all evidence, testimony, written documentation and public comments; <br />and <br />Resolution 48-22 Page 1 <br />
