RESOLUTION 67-22 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS GRANTING AN APPEAL OF THE PLANNING COMMISSION IMPOSED CONDITIONS OF APPROVAL FOR A SITE DEVELOPMENT PERMIT FOR LANDSCAPE SCREENING, FENCING, DRIVEWAY GATE, AND A NEW OUTDOOR KITCHEN AT 12869 LA CRESTA DRIVE AND IMPOSE CERTAIN CONDITIONS OF APPROVAL WHEREAS, The Town of Los Altos Hills received an application for a Site Development Permit (SD21-0079) from Paragon Custom Builders on behalf of property owner, Nicholas Sutardja ("Applicant") for landscape screening plan associated with a previously approved single-family home (SD18-0001) at 12869 La Cresta Drive ("Project"); and WHEREAS, based on the record presented before it, the Project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15304(b) and 15303(e) as the project includes new landscaping, fencing, driveway gate, and outdoor kitchen; and WHEREAS, the Project application was processed in accordance with the applicable provisions of the California Government Code and the Los Altos Hills Municipal Code; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on May 12, 2022 and considered all written documentation and public comments; and WHEREAS, the Planning Commission voted 4-0-0-1- to adopt the resolution to approve the Site Development Permit for landscape screening plan associated with a previously approved single- family home with conditions; and WHEREAS, on June 2, 2022, the Applicant submitted a Notice of Appeal to the City Cleric to appeal the Planning Commission's conditions of approval to the City Council; and WHEREAS, the City Council held a duly noticed public hearing to consider the appeal on June 16, 2022, and considered all evidence, testimony, written documentation and public comments; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills hereby grants the appeal. The conditions of approval for the Site Development Permit (SD21- 0079) for landscape screening at 12869 La Cresta Drive shall be revised as set forth in the record of the June 16, 2022 public hearing. Town staff is hereby directed to prepare an updated list of the revised conditions of approval in accordance- with the hearing records and attached hereto and incorporated herein as Exhibit A. The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los Altos Hills at a regular meeting held on the 16" day of June 2022, by the following vote: AYES: Tyson, Swan, Mok, Schmidt, Tankha Resolution 67-22 Page 1
