ORDINANCE 602 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF <br />LOS ALTOS HILLS AUTHORIZING AN AMENDMENT TO THE CONTRACT <br />BETWEEN THE TOWN OF LOS ALTOS HILLS AND THE BOARD OF <br />ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES RETIREMENT <br />SYSTEM <br />WHEREAS, the Town of Los Altos Hills ("Town") entered into a contract with the Board of <br />Administration of the California Public Employees' Retirement System ("Ca1PERS") effective <br />July 1, 1967, amended effective June 1, 1976, July 1, 1998, January 1, 2006, September 1, 2011, <br />and January 1, 2013, which provides for participation in Ca1PERS ("Contract"); and <br />WHEREAS, the Ca1PERS' Office of audit services ("OFAS") conducted and provided a Public <br />Agency Review ("PAR") in March of 2021; and <br />WHEREAS, the purpose of the PAR was to determine how the Town applies the retirement <br />exclusion in the Contract for all hourly employees ("Contract Exclusion"); and <br />WHEREAS, the Town is adhering to the membership eligibility requirements in Government <br />(Gov.) Code section 20305 and amending the Contract because the Contract Exclusion for all <br />hourly employees is invalid as it is superseded by Gov. Code section 20305(b); and <br />WHEREAS, the Town now desires to remove the Contract Exclusion from the Contract. <br />NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as <br />follows: <br />Section 1. <br />FINDINGS. The City Council of the Town of Los Altos Hills finds that all Recitals are true and <br />correct and incorporated herein by reference. <br />Section 2. <br />CONTRACT AMENDMENT. That an amendment to the contract between the Town of Los <br />Altos Hills and the Board of Administration, California Public Employees' Retirement System is <br />hereby authorized, a copy of said amendment being attached hereto as Exhibit A, and by such <br />reference made a part hereof as though herein set out in full. <br />Section 3. <br />The City Manager of the Town of Los Altos Hills is hereby authorized, empowered, and directed <br />to execute said amendment for and on behalf of the Town. <br />Section 4. <br />SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or <br />circumstance is held invalid or unconstitutional, the remainder of this Ordinance, including the <br />application of such part or provision to other persons or circumstances shall not be affected <br />thereby and shall continue in full force and effect. To this end, provisions of this Ordinance are <br />severable. The City Council of the Town of Los Altos Hills hereby declares that it would have <br />passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof <br />Ordinance 602 Page 1 <br />
