RESOLUTION 45-23 A RESOLUTION ACCEPTING THE IMPROVEMENTS TO CONCESSION. BUILDING AT PURISSIMA PARK PROJECT AS COMPLETE, AUTHORIZING FINAL RETENTION PAYMENT TO THE CONTRACTOR, AND DIRECTING THE CITY CLERK TO FILE NOTICE OF COMPLETION WHEREAS, the Concession and Community Building at Purissima Park is a capital; proj ect in the Adopted.FY22-23 Operative Budget and FY2023-2027 Five -Year Capital Improvement Plan with designated funding; and WHEREAS, the project scope includes retrofitting. the existing concession building, remodeling the interior to convert the two non -operational restrooms/storage to a community room, and making the building to ADA compliance; and WHEREAS, the City Council approved the award of the Improvements to Concession Building at Purissima Park construction contract to MTW Builders, Inc. on May 25, 2022; and WHEREAS, the contracted work was substantially completed on March 24, 2023; and WHEREAS, the Improvements to Concession Building at Purissima Park Project has been inspected by staff, and the project is deemed to be completed; and WHEREAS, once the City Council accepts the project, staff will remit the five percent retention to the Contractor 35 days following the project acceptance. NOW,. THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows Section 1. As recommended by staff, the, City Council accepts the Improvements to Concession Building at Purissima Park construction project,by MTW Builders, Inc. as complete and authorizes staff to make the final retention payment concerning the above-described work. Section 2. The City Clerk is hereby directed to file the notice of the completion of said project with -the County Recorder of the County of Santa Clara, within ten (10) days from the date of this Resolution. The above and foregoing resolution was passed and adopted by the City Council of the Town of Los Altos Hills at a special meeting held on the 17th day of May 2023 by the following vote: AYES:' Swan, Mok, Schmidt, Tankha, Tyson NOES: None AB STAIN: None ABSENT: None Resolution 45-23 Page 1
