RESOLUTION 54-23 <br />A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS <br />REJECTING ALL BIDS RECEIVED FOR THE 2023 PAVEMENT REHABILITATION <br />AND DRAINAGE IMPROVEMENT PROJECT; APPROVING REVISED PROJECT <br />PLANS AND SPECIFICATIONS FOR STAFF TO ADVERTISE FOR FORMAL BID <br />(RE -BID); AND AUTHORIZING THE CITY MANAGER TO AWARD A <br />CONSTRUCTION CONTRACT NOT TO EXCEED $1,390,000 TO THE LOWEST <br />RESPONSIBLE BIDDER, INCLUDING CONTINGENCY FOR POTENTIAL CHANGE <br />ORDERS <br />WHEREAS, on April 20, 2023, the City Council approved the Plans and Specifications for the <br />2023 Pavement Rehabilitation and Drainage Improvement Project and authorized staff to advertise <br />the project for a formal bid; and <br />WHEREAS, on April 26, 2023, the Town advertised the project for a formal bid in the Los Altos <br />Crier and on the Town's website; and <br />WHEREAS, the Town received four (4) bids on May 17, 2023; and <br />WHEREAS, all four bids for Base Bid exceeded the Engineering Estimate of $1.2 million and are <br />over the current project budget; and <br />WHEREAS, pursuant to Public Contract Code section 20166, a legislative body of a public <br />agency may reject any bids received for a public project; and <br />WHEREAS, staff recommends that Council reject all bids received for the 2023 Pavement <br />Rehabilitation and Drainage Improvement Project, approve a reduced scope of the project for a re- <br />bid; and authorize the City Manager to award a construction contract not to exceed $1,390,000, <br />including contingency funds, to the lowest responsible bidder to allow construction to start by <br />August 2023. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills <br />that: <br />1. All bids received for the 2023 Pavement Rehabilitation and Drainage Improvement <br />Project are hereby rejected. <br />2. The revised project plans and specifications as described in the staff report to the City <br />Council for the agenda item are hereby approved for advertisement for a formal bid <br />(re -bid). <br />3. The City Manager is authorized to award and execute a construction contract not to <br />exceed $1,390,000 with the lowest responsible bidder for the project. <br />Resolution 54-23 Page 1 <br />
