RESOLUTION 95-23 A RESOLUTION ACCEPTING THE 2022 SANITARY SEWER REPAIR AND REPLACEMENT PROJECT AS COMPLETE, AUTHORIZING FINAL RETENTION PAYMENT TO THE CONTRACTOR, AND DIRECTING THE CITY CLERK TO FILE NOTICE OF COMPLETION WHEREAS, on December 15, 2022, the City Council approved the Plans and Specifications for the 2022 Sanitary Sewer Repair and Replacement Project and authorized staff to advertise the project for formal bid. WHEREAS, on March 16, 2023, the City Council awarded the project to the lowest responsible bidder, C2R Engineering, Inc., and authorized the City Manager to execute a construction agreement not to exceed $532,220 including contingency; and WHEREAS, construction agreement was executed on March 22, and the work started on April 14, 2023; and WHEREAS, the project was substantially completed on June 23, 2023; and WHEREAS, the total project expenditure for the contracted work by C2R Engineering is $456,820.32, which is below the amount authorized by the City Council; and WHEREAS, Staff recommends that the City Council accept the 2022 Sanitary Sewer Repair and Replacement Project by C2R Engineering as completed and allow the remittance of the five percent retention to the contractor 35 days following the project acceptance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills that: Section 1. As recommended by staff, the City Council accept the 2022 Sanitary Sewer Replacement and Repair Project by C2R Engineering, Inc. as complete and authorize staff to make the final retention payment concerning the above-described work. Section 2. The City Cleric is hereby directed to file the notice of the completion of said project with the County Recorder of the County of Santa Clara, within ten (10) days from the date of this Resolution.
