RESOLUTION 18-24 <br />A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS <br />REGARDING USE OF THE AMERICAN RESCUE PLAN ACT (ABPA) FUNDS <br />WHEREAS, on March 11, 2021, President Biden signed into law HR 1319, the American Rescue <br />Plan Act of 2021 ("ARPA"), which provides financial assistance to individuals, businesses, and <br />state and local government agencies to assist in the economic recovery from the COVID-19 <br />pandemic; and <br />WHEREAS, ARPA includes a provision entitled "Coronavirus State and Local Fiscal Recovery <br />Funds program ("SLFRF") that includes $350 billion in funding for state, territorial, local, and <br />Tribal governments of which $65 billion is dedicated to local government agencies; and <br />WHEREAS, the provision in SLFRF provide flexibility for each government to meet local needs <br />in four areas: 1) supporting public response to public health impacts and negative economic <br />impacts of the pandemic; 2) provide premium pay for essential workers; 3) replace lost public <br />sector revenues; and 4) -)invest in water, wastewater, and broadband infrastructure; and <br />WHEREAS, the Town of Los Altos Hills ("Town") is classified as a non -entitlement unit agency <br />with the provisions of SLFRF, was informed that its total allocation is $2,014,960, and that the <br />allocation would be paid in two equal payments of $1,007,,480. The first payment was received <br />on July 13, 2021 and the second payment received on July 21, 2022; and <br />WHEREAS, the U.S. Department of the Treasury ("Treasury") is responsible for administration <br />and distribution of SLFRF funds and issued its Interim Final Rule (31 CFR Part 35, RIN 1505- <br />AC77) on May 10, 2021, that establishes provisions for the use of the SLFRF funds; and <br />WHEREAS, the Town has identified and approved fourteen projects in previous staff reports that <br />would provide the opportunity to use all of the ARPA funds received. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the Town of Los Altos Hills <br />as follows: <br />1. The City Manager, or designee, is authorized to apply for, receive, and file required reports <br />on the Town's allocation of ABPA - SLFRF funds. <br />2. The SLFRF funds received from Treasury shall be deposited into the Town's funds and <br />said funds will be tracked and reported in accordance with the provisions of ARPA and the <br />Interim Final Rule. <br />3. The Town shall use the funds based on City Council direction as outlined in the staff report <br />dated April 15, 2024, with the addition of keeping broadband on the list. <br />4. As per the staff report dated April 15, 2024, Council directs staff to amend the approved <br />project list to reflect COVID-related modifications to cubicles at Town facilities consistent <br />with public health mandates and recommendations. <br />Resolution 18-24 <br />
