RESOLUTION NO. 3 6-0 5 <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE TOWN OF LOS ALTOS HILLS ELECTING TO BE SUBJECT TO <br /> STATE DISABILITY INSURANCE UNDER THE CALIFORNIA <br /> UNEMPLOYMENT INSURANCE CODE SECTION 709 <br /> WHEREAS, the Town does not currently participate in a Short-Term Disability Insurance program; <br /> and, <br /> WHEREAS, if Town employees are temporarily disabled for non-work related injury or illness, they <br /> have no coverage for the first ninety days; and, <br /> WHEREAS, it is in the best interest of the employees to participate in the State Short-Term <br /> Disability Insurance program. <br /> NOW,THEREFORE,THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS <br /> DOES HEREBY FIND,DETERMINE AND RESOLVE AS FOLLOWS: <br /> 1. Upon approval of the election by the Director of the Employment Development Department, <br /> the Town will be an employer subject to the California Unemployment Insurance Code <br /> (CUIC)for State Disability Insurance purposes only to the same extent as other employers as <br /> of the date specified in the approval and will remain a subject employer for at least two <br /> complete calendar years.Thereafter, this election may be terminated as provided by the <br /> CUIC. <br /> 2. All employees will be covered and employee contributions shall be used exclusively to <br /> finance the City's participation in the state disability insurance program. <br /> 3. The City Manager is hereby directed and authorized to file an application under Section 709 <br /> of the CUIC to become an employer subject to the CUIC. <br /> 4. The Administrative Services Director shall post and maintain the printed notice (DE 1375C, <br /> Notice To Employees Elective Coverage Application for State Disability Insurance)of such <br /> election or application at Town buildings. <br /> PASSED, and ADOPTED this 5th day of May 2005. <br /> / // <br /> MAYOR <br /> ATTEST: <br /> CITY C #17 - <br />
