Copies. . <br /> Town of Los Altos Hills and is AMT PAID <br /> Exempt from Fee per Government <br /> Code Sections 27381 and 6103 • BRENDA DAVIS RDE # 009 <br /> SANTA CLARA COUNTY RECORDER 1/28/2002 <br /> When Recorded, Mail to: Recorded at the request of 12 02 PM <br /> City <br /> City Clerk <br /> Town of Los Altos Hills <br /> 26379 Fremont Road <br /> Los Altos Hills, CA 94022 <br /> RESOLUTION NO. 12-02 <br /> RESOLUTION OF THE CITY COUNCIL OF THE <br /> TOWN OF LOS ALTOS HILLS TO VACATE SUMMARILY <br /> THE SANITARY SEWER EASEMENT ON LANDS OF PERRELL <br /> WHEREAS, for the benefit of the general public, a ten (10) foot Sanitary Sewer <br /> easement described in Exhibit A, hereto("Original Easement")was placed on the property <br /> commonly known as 26300 Silent Hills Lane, and more particularly described in Exhibit B <br /> ("Property"); and <br /> WHEREAS, Charles F. Perrell, Trustee, of the Charles F. Perrell Trust Agreement <br /> dated September 2, 1988 as amended and restated June 26, 1998, the current owner of <br /> the Property ("Owner"), has requested that the Original Easement be vacated because it <br /> will be superseded by relocation; and <br /> WHEREAS, concurrently herewith, the Owner will dedicate to the Town a new <br /> fifteen(15)foot sanitary sewer easement over the Property("New Easement"),which offer <br /> will be accepted by the Town at this time; and <br /> WHEREAS, the City Council of the Town now desires summarily to vacate the <br /> Original Easement. <br /> NOW, THEREFORE, the City Council of the Town does RESOLVE as follows: <br /> 1. The City Council of the Town, pursuant to California Streets and Highways <br /> Code, Division 9, Chapter 4, Section 8333, et seq., hereby vacates the Original Easement <br /> and finds that the Original Easement has been superseded by the New Easement and no <br /> other public facilities are located within the easement. <br /> 1 N:\DATA\Clients\L\LAH\Projects\Ferrell\VacSewer.eas.wpd <br />
