Perrell, Trustee, of the Charles F. Perrell Trust Agreement <br /> dated September 2, 1988 as amended and restated June 26 1998, the current owner of <br /> the Property ("Owner"), has requested that the Original Easement be summarily vacated <br /> because the Trail Easement has not been used for the purpose for which it was dedicated <br /> for the past five (5) consecutive years; and <br /> WHEREAS,the City Council of the Town now desires summarily to vacate the Trail <br /> Easement. <br /> NOW,THEREFORE, the City Council of the Town does RESOLVE as follows: <br /> 1. The City Council of the Town, pursuant to California Streets and Highways <br /> Code, Division 9, Chapter 4,Section 8333,et seq., hereby vacates the Trail Easement due <br /> to non-use for the past five (5) consecutive years. <br /> 2. The Parcel Maps showing the location of the Trail Easement were filed on <br /> April .1, 1991, in Book 625 of Maps at Pages 4-6 and on December 30, 1998, in Book 711 <br /> of Maps at Pages 49-50, and are both on file in the Santa Clara County Recorder's Office <br /> • 3.
