• • NOW,THEREFORE,the City Council of the Town of Los Altos Hills does RESOLVE as follows: 1. The foregoing recitals are true and correct and are included herein by reference. 2. The specific facts supporting the statements and findings in this Resolution are set out in detail in the March 28, 2002 Initial Study and the May 10, 2002 staff report. 3. The City Council of the Town of Los Altos Hills, pursuant to California.Streets and Highways Code, Division 9, Chapter 3, Section 8320, et seq., hereby orders the vacation of the Easement described in Exhibit A hereto, having determined and found that the Easement is unnecessary for present or prospective public purposes. 4. ' The Easement Deed showing the location of the Pathway and Trail Easement was filed in Book 631 at Pages 53 - 57, as Document No. 8720352, in the Santa Clara County Recorder's Office on March 17, 1986. 5. This Resolution shall become effective on June 17, 2002 and shall be recorded by the City Clerk in the Santa Clara County Recorder's Office shortly thereafter. 6. From and after the date this Resolution is recorded in the Santa Clara County Recorder's Office, the Pathway and Trail Easement shall no longer constitute a public easement and the land subject to the Easement shall revert to the Property pursuant to Streets and highways Code Section 8351, except as burdened by the Conservation Easement referred to in Section 7 below. • 7. The vacation of the Pathway and Trail Easement shall in no way affect the Conservation Easement granted to the Town and recorded in Book 631, Pages 53 - 57, as Document No. 8720352, in the Santa Clara County Recorder's Office on March 17, 1986, and this Conservation Easement shall remain in full_force and effect.
