• <br /> • <br /> NOW,THEREFORE,the City Council of the Town of Los Altos Hills does RESOLVE <br /> as follows: <br /> 1. The foregoing recitals are true and correct and are included herein by <br /> reference. <br /> 2. The specific facts supporting the statements and findings in this Resolution <br /> are set out in detail in the March 28, 2002 Initial Study and the May 10, 2002 staff report. <br /> 3. The City Council of the Town of Los Altos Hills, pursuant to California.Streets <br /> and Highways Code, Division 9, Chapter 3, Section 8320, et seq., hereby orders the <br /> vacation of the Easement described in Exhibit A hereto, having determined and found that <br /> the Easement is unnecessary for present or prospective public purposes. <br /> 4. ' The Easement Deed showing the location of the Pathway and Trail Easement <br /> was filed in Book 631 at Pages 53 - 57, as Document No. 8720352, in the Santa Clara <br /> County Recorder's Office on March 17, 1986. <br /> 5. This Resolution shall become effective on June 17, 2002 and shall be <br /> recorded by the City Clerk in the Santa Clara County Recorder's Office shortly thereafter. <br /> 6. From and after the date this Resolution is recorded in the Santa Clara County <br /> Recorder's Office, the Pathway and Trail Easement shall no longer constitute a public <br /> easement and the land subject to the Easement shall revert to the Property pursuant to <br /> Streets and highways Code Section 8351, except as burdened by the Conservation <br /> Easement referred to in Section 7 below. <br /> • <br /> 7. The vacation of the Pathway and Trail Easement shall in no way affect the <br /> Conservation Easement granted to the Town and recorded in Book 631, Pages 53 - 57, <br /> as Document No. 8720352, in the Santa Clara County Recorder's Office on March 17, <br /> 1986, and this Conservation Easement shall remain in full_force and effect. <br /> PASSED AND ADOPTED this 16th day of May , 2002. <br /> • <br /> B _„ <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> 2 N:\DATA\Clients\ULAH1Projects\CarselVacation2.rut.wpd <br />
