• <br /> RESOLUTION No. 111-0 2 <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE TOWN OF LOS ALTOS HILLS <br /> ACCEPTING THE PUBLIC FACILITIES FEES FUND SUMMARIES REPORT <br /> AND MAKING THE REQUIRED STATUTORY FINDINGS <br /> WHEREAS, the City Council of the Town of Los Altos Hills has adopted Ordinances <br /> 381 and 401 authorizing the collection of pathway and drainage fees,respectively; <br /> AND WHEREAS the Town is required by State Law to report and make certain findings <br /> (Government Code Section 66001) on its Public Facilities Program every five years with <br /> respect to that portion of the funds remaining unexpended; <br /> NOW THEREFORE, the City Council of the Town of Los Altos Hills does resolve to <br /> accept the Public Facilities Fee Annual Report(Exhibit I). <br /> BE IT FURTHER RESOLVED,that the Council make the following findings: <br /> 1. The purpose to which the fees is to be put is identified as follows: <br /> • Pathway fees are to be used exclusively for the maintenance, repair, construction <br /> and acquisition of property for the Town's pathway system. <br /> • Drainage fees are to be used solely for the construction, or reimbursement of <br /> construction, of local drainage facilities within the Town, or to reimburse the <br /> Town for the cost of engineering and administrative services related to the Master <br /> Plan for Storm Water Drainage and the design and construction of the facilities. <br /> 2. A reasonable relationship between the fee and the purpose for which it is charged is <br /> demonstrated as follows: <br /> • Pathway fees are set at a rate necessary to recover the cost of pathway <br /> maintenance, repair and construction. Storm drainage fees are set a the rate <br /> necessary to recover the cost of construction of local drainage facilities within the <br /> Town, or to reimburse the Town for the cost of engineering and administrative <br /> services related to the Master Plan for Storm Water Drainage. At the meeting of <br /> November 21, 2002, Council approved a revised schedule of"Fees,Deposits, <br /> Charges for Service, and Other Assessments," which included the pathways and <br /> storm drainage fees. <br />
