Packard, Nancy P. <br /> Burnett, Susan P. Orr and Julie Packard, Trustees of The David <br /> and Lucile Packard Trust dated April 20, 1987, as <br /> amended, ( "Owner" ) and the Town of Los Altos Hills, a municipal <br /> corporation, ( "Town" ) . <br /> RECITALS <br /> A. Owner is the owner of certain real property <br /> ( "Property" ) in the Town of Los Altos Hills commonly known as <br /> 26580 Taaffe Road, and more particularly described in Exhibit A, <br /> attached hereto . <br /> B. Town has adopted a General Plan and, pursuant thereto, <br /> may accept grants of conservation easements on privately owned <br /> lands lying within the Town. <br /> C. Town finds this conservation easement to be consistent <br /> with the Town' s General Plan and in the best interest of the <br /> Town. <br /> D. Pursuant to the use. permit issued for the Property, <br /> allowing certain non-residential uses ( "Use Permit" ) , Owner and <br /> Town desire to limit the use of a portion of the Property by <br /> dedication of a conservation easement in order to preserve the <br /> existing apricot orchard and adjacent open space riparian areas . <br /> Recognizing that such land is improved only with an orchard and <br /> related irrigation, equipment storage and repair facilities and <br /> fencing, and if retained in this state has substantial scenic <br /> value to the Owner and the public, the Owner and Town agree that <br /> the preservation of such land as an orchard and adjacent open <br /> space riparian areas constitutes an important historical, physi- <br /> • 12954459 <br />
