• • <br /> RESOLUTION NO. 4—ll <br /> RESOLUTION OF THE CITY COUNCIL OF THE <br /> TOWN OF LOS ALTOS HILLS <br /> SUMMARILY VACATING A PUBLIC SERVICE EASEMENT <br /> (Lands of Long) <br /> WHEREAS, Timothy J. Long and Claranne R. Long, trustees of the Long Living Trust <br /> ("Owners"), are the owners of the property commonly known as 14060 Baleri Ranch Road, Los <br /> Altos Hills, California; and <br /> WHEREAS, Owners offered, and the Town accepted an easement for the construction, <br /> operation and maintenance of existing and future pathway facilities, for pedestrian, bicycle and <br /> equestrian use ("Pathway Easement") on Owners' property; and <br /> WHEREAS, because of the acceptance of the Pathway Easement by the Town, the <br /> existing public service easement ("Existing Easement") located on Owners' property has been <br /> superseded by relocation; and <br /> WHEREAS, pursuant to the provisions of Section 8330 et seq., of the Streets and <br /> Highways Code, the City Council of the Town of Los Altos Hills seek to summarily vacate the <br /> Existing Easement; and <br /> WHEREAS, there are no public utility facilities in use or affected on the Existing <br /> Easement; and <br /> NOW, THEREFORE, the City Council of the Town of Los Altos Hills does <br /> RESOLVE as follows: <br /> 1. The foregoing recitals are true, correct, and incorporated herein by reference. <br /> 2. The Existing Easement described above and in Exhibit A is hereby summarily <br /> vacated pursuant to Chapter 4 of Division 9, Part 3 of the California Streets <br /> and Highways Code, concerning summary vacation of easements. <br /> 3. The City Clerk is directed to cause a certified copy of this resolution, attested <br /> by the Clerk under seal, to be recorded in the office of the County Recorder of <br /> the County of Santa Clara. <br /> 4. From and after the date of this resolution is recorded, the Existing Easement <br /> shall no longer constitute a public service easement. <br /> [next page] <br />
