Review the attached Ordinance No. 1970-100, Residential Data Report, and <br /> accompanying literature. <br /> BACKGROUND <br /> On November 13, 2003, the Planning Commission reviewed and approved an application for a <br /> Site Development Permit to legalize an existing nonconforming pool patio and hardscape <br /> improvements and Variances to exceed the MDA and to encroach into the 30-foot side yard <br /> setback. During the Commission's discussion, staff was asked whether real estate agents were <br /> required to research property microfiche records and provide proof of permits or disclosure <br /> statements to prospective sellers. <br /> jStaff queried several Towns similar to Los Altos Hills and found that the Town of Portola Valley <br /> has an ordinance that requires a property owner or authorized representative to obtain from the <br /> City a report of the residential building record showing the regularly authorized use, occupancy, <br /> and zoning classification of the property, prior to entering into an agreement of sale or exchange <br /> of any residential building. The intent of the ordinance is to protect the unwary buyer of <br /> residential property against undisclosed restrictions on the use of the property. The property <br /> owner or his authorized agent submit an application and fee to the City and the City provides a <br /> report containing all available information regarding the residential building record, valid for a <br /> period not to exceed six months from the date of issuance. The property owner or authorized <br /> representative is responsible for the delivery of the report to the buyer or transferee of the <br /> residential building prior to the sale or exchange. The buyer or transferee executes a receipt, <br /> provided by the City, and returns the receipt to the City as evidence of compliance with the <br /> provisions of the ordinance. <br /> Staff is available to answer any questions that the Commission or the public may have. <br /> ATTACHMENTS <br /> 1.
