Approve the height increase of the structure and prohibit the access and use of the <br /> roof for deck purposes; OR <br /> 2. Deny the requested Site Development Permit Modification (comply with original <br /> approved plans); OR <br /> 3. Approve the requested Site Development Permit Modification, subject to the <br /> recommended conditions in Attachment 1 except for Condition#2. <br /> BACKGROUND <br /> The subject property is located at the corner of Cortez Lane and Altamont Road. <br /> Surrounding uses include single-family homes on adjacent parcels to the north and west, <br /> a single-family home across Cortez Lane to the east, and Byrne Preserve across Altamont <br /> Road to the south. <br /> At a public hearing on September 16, 2003, the Planning Director approved a Site <br /> Development Permit to construct a 650 sq. ft. addition, 626 sq. ft. second unit, and an 800 <br /> sq. ft. swimming pool on the property. At that time, no complaints have been received <br /> from the public. On October 22, 2003, a building permit was approved for the addition. <br /> (BP# 12726) <br /> On January 12, 2004, the adjacent neighbor at 12971 Cortez Lane contacted staff to <br /> complain that the addition appears taller than what the story poles had shown back in <br /> September 2003. In addition, the roof deck looks directly over their pool and office/study <br /> area, raising serious concerns about privacy and view impacts. <br />
