Staff Report to the Planning Commission <br /> Lands of Chou <br /> 12951 Cortez Lane <br /> April 8,2004 <br /> Page 3 of 10 <br /> CODE REQUIREMENTS <br /> Condition #1 of the Site Development Permit approval states that "No other <br /> modifications to the approved plans are allowed except as otherwise first reviewed and <br /> approved by the Planning Director or the Planning Commission, depending on the scope <br /> of the changes." <br /> The height of the as-built structure measured from the building pad to the top of the roof <br /> railing is 2.5' higher than what was originally approved. Furthermore, the Town has <br /> received numerous height related complaints from neighbors regarding this project <br /> (Attachments#4-8). Therefore, the Planning Director determined that the unauthorized and <br /> proposed modifications warrant the review by the Planning Commission at a public hearing. <br /> DISCUSSION <br /> Site Data: <br /> Gross Lot Area: 1.005 acres <br /> Net Lot Area: 0.816 acres <br /> Average Slope: 7.1% <br /> Lot Unit Factor: 0.816 <br /> Floor Area and Development Area: <br /> Area (sq.ft.) Requirements <br /> to reduce light emission from skylights are included. (Condition#10) <br /> Section 10-1.504 of the Zoning Code allows a maximum building height of 27'. The <br /> proposed request to increase the structural height of the addition from 21.2' to 23.7' <br /> complies with the Town's height requirements.
