Dewar ("Dewar's") in favor of the Town of Los Altos Hills, a <br /> Y ( ) <br /> municipal corporation of the State of California ("Town"), effective as of the date of <br /> execution by the Town. <br /> RECITALS <br /> A. Dewar's own property located at 27761 Moody Road in the Town of Los <br /> Altos Hills, California, being that certain parcel of land described in the Certificate of <br /> Compliance in Exhibit "A" and shown in Exhibit "B" filed for record in the Office of <br /> the Recorder of the County of Santa Clara, State of California, on April 22, 1994, in <br /> Book N408 of Official Records, pages 1731 to 1734. <br /> B. Dewar's desire to grant an easement in this property to the Town for a <br /> pathway, and Town wishes to accept such easement. <br /> P Y� P <br /> NOW, THEREFORE, IT IS AGREED by the parties as follows: <br /> 1. Right of Way. Dewar's hereby grant to the Town an easement as <br /> described in Exhibit "A" and shown in Exhibit "B" attached hereto for public <br /> pathway purposes, including, but not limited to, pedestrian, bicycle and equestrian <br /> purposes. <br /> 2. Acceptance. The Town has accepted this Easement by Resolution No. <br /> 38-94 and has authorized the Mayor to execute this document on its behalf. <br /> 3. Binding Effect. The Provisions contained in this Easement shall <br /> run with the land and shall be binding upon and inure to the benefit of the <br /> respective successors and assigns of the parties to this Dedication. <br />
