LANDS OF RAMEY, File #VAR. 7061-79, 23935 Jabil Lane, Request for Recommendation
of Approval of Variance for Pool
Mr. Carlson referred Commissioners to his staff report for his recommendation of
approval of the variance request. A short discussion followed on a request made
by the Pathway Committee for a pathway on the Lands of Ramey; but it was concluded
that unless the owner consented to the request, the Town could not require it.as
a condition for the granting of the variance. Thereafter the hearing was opened
to the public discussion.
Robert White, 23930 Jabil Lane, spoke against a pathway on Jabil Lane and noted
that neighbors did not want the path and that Jabil Lane is a private road.
The public hearing was closed and Commissioners discussed the proposed pathway
further. Commissioner Carico noted that the policy of requiring pathway dedications
was to keep horses and children off the main thoroughfares of the Town, not to con-
fiscate anyone's property, further, that no one was trying to intrude or ruin any-
one's property.
Mrs. Ra me A 1icant, discussed the use of the proposed pathway by neighborhood
c ildren over t e years. She noted, however, that the path used had been with
the Ramey's permission. The path had never been in use as a permissive path for
everyone. She noted, however, that her neighbor had fenced off her property from
tawpath users, and that the path area has been a bone of contention in the area, also
that the owners of the private road would have to give their permission on the use
of the private road as access to a pathway.
