a <br />VARIANCE AND PERMIT COMPASSION <br />Town of Los Altos Hills <br />ILI 26379 Fremont Road <br />Los Altos Hills, California <br />MINUTES OF A REGULAR MEETING <br />Wednesday, February 13, 1980 <br />Reel 83, Side 1, Tr. 2, 001 to 138 <br />Chairman Carico called the meeting of the Variance and Permit Commission to order <br />at 7:00 p.m. in the Council Chambers of the Town Hall. <br />ROLL CALL: <br />Present: Commissioners Stewart, Dochnahl, Carico <br />Absent: None <br />Also Present: City Engineer/Planner John Carlson, Secretary Ethel Hopkins <br />APPROVAL OF MINUTES: <br />MOTION SECONDED AND CARRIED: It was moved by Commissioner Dochnahl and seconded <br />by Commissioner Carico that the Minutes of January 23 be approved as submitted. <br />Commissioners Dochnahl and Carico voted for the motion; Commissioner Stewart, however, <br />abstained because he had not attended the January 23rd meeting. <br />L PUBLIC HEARINGS: <br />fir' 1. LANDS OF MORLEY, File #VAR. 7065-79, 12345 Murietta Lane, Request for Variance <br />for Tennis Court continued from January 23rd meeting): <br />Mr. Carlson continued the discussion on the above variance, noting that efforts to <br />obtain an idea of what the ultimate development of the Duvenek property would be had <br />proven unsuccessful. He noted that the applicant had re -submitted plans which would <br />require only a ten foot encroachment into the setback area. The width of the court <br />had been reduced from sixty to fifty-five feet. No other changes had been made. <br />Thereafter, the hearing was opened to the public discussion. <br />Mr. Morley, A a cant, discussed the shape of the lot and the constraints placed on <br />eve opment as a resu t and the subsequent reasons for requesting a variance. He <br />requested a recommendation of approval of the variance. <br />Commissioner Stewart reminded Mr. Morley that the conditions of the Rancho Murietta <br />Subdivision prevented the requesting of a variance because of the creek along the <br />property. He also noted that the costliness of constructing a bridge as access to <br />the adjacent Duvenek property would not be a deterrant to development of that property, <br />land values being what they are in the area. He suggested revising the plans again, <br />moving the proposed dwelling further back from the setback area and eliminating one <br />of the garage areas. <br />The public hearing was closed, and Commissioners discussed the disposition of the <br />request. Commissioner Carico commended the applicant's proposed development as <br />it retained the rural quality of the area, lessened impact on Murietta, and kept <br />trees intact. She noted, however, the the question of hardship was difficult to <br />establish. Commissioners discussed various ways that the applicant might develop <br />his lot without having to have a variance, and then passed the following motion: <br />
