0 N <br />VARIANCE AND PERMIT COMMISSION <br />Town of Los Altos Hills <br />26379 Fremont Road <br />Los Altos Hills, California <br />MINUTES OF A REGULAR MEETING <br />Wednesday, March 26, 1980 <br />Reel 84, Side 1, Tr. 1, 795 to 1014 <br />The meeting of the Variance and Permit Commission was called to order by Chairman <br />Rydell at 7:00 p.m. <br />ROLL CALL: <br />Present: Commissioners Lachenbruch, Stewart and Rydell <br />Absent: None <br />Also Present: City Engineer/Planner John Carlson, Secretary Ethel Hopkins <br />APPROVAL OF MINUTES: <br />The Minutes of March 12 were amended as follows: The last line of page one was <br />changed to read ..located in another location other than above the heat storage <br />tank." Thereafter the Minutes were approved as amended on The—motion of Commissioner <br />Stewart seconded by Commissioner Lachenbruch. Commissioner Rydell abstained from <br />the voting. The Minutes were declared approved on the "aye" votes of the two <br />ow Commissioners. <br />PUBLIC HEARINGS: <br />1. LANDS OF MAREK, File #VAR. 3-80, 25151 Tepa Way, Request for Recommendation of <br />pp <br />Aroval of Variance in Side and Rear Setback for the Construction of a Garage: <br />Mr. Carlson reviewed the above request as covered in his staff report of March 20, <br />noting that there was no additional impervious surface with the garage addition <br />proposed and that the present garage use was restricted because of the original <br />lot development. <br />Commissioner Lachenbruch asked about the crack in the retaining wall near the pro- <br />posed garage addition, and requested that it be determined whether this would affect <br />the new construction. He also asked about the ownership of the common driveway ease- <br />ment. Thereafter the hearing was opened to the public discussion. <br />John Marek, Applicant, noted that the underlying fee title was owned by Mr. and Mrs. <br />David Hu�at the Mareks and Hobarts have a non-exclusive driveway and parking <br />easement for the driveway. He questioned the accuracy of the staff report in stating <br />the amount of the variance request. Also, he noted that they had been observing the <br />crack in the retaining wall, that it had changed very little in the past ten years, <br />that the vertical displacement had been caused by the movement of the ground below <br />the retaining wall, and that the retaining wall had very little to do with the <br />4 proposed construction. He suggested that perhaps the building inspector may wish to <br />observe the area during inspections on the addition. He asked that the variance be <br />approved. <br />The public hearinq was closed and discussion returned to the Commissioners. <br />
