VARIANCE AND PERMIT COMMISSION <br />Town of Los Altos Hills <br />26379 Femont Road <br />Los Altos Hills, California <br />MINUTES OF A REGULAR MEETING <br />Wednesday, July 9, 1980 <br />Reel 87, Side 1, Tr. 2, 526 to 615 <br />Chairman vanTamelen called the meeting to order at 7:00 p.m. in the Council Chambers <br />of the Town Hall. <br />ROLL CALL: <br />Present: Commissioners Rydell, Dochnahl, and vanTamelen <br />Absent: None <br />Also Present: Assistant Planner Pat Webb, Secretary Ethel Hopkins <br />APPROVAL OF MINUTES: <br />APPROVAL OF MINUTES OF JUNE 25, 1980: It was moved by Commissioner Dochnahl and <br />seconded by Commissioner vanTamelen that the Minutes of June 25 be accepted as <br />presented. Thereafter the Minutes were declared approved by Chairman vanTamelen. <br />PUBLIC HEARINGS: <br />1. LANDS OF SMITH, File #VAR. 5-80, 25521 Altamont Road, Request for Recommendation <br />4 of Approval for Variance for Addition to Dwelling <br />,r Pat Webb discussed the above request, noting that the staff report should be amended <br />to include a pre-existing incursion of ten feet into the side yard setback for the <br />original dwelling, and that the stable and paddock area on the property had not been <br />noted on the variance map. She added that the area where the addtion would be located <br />was flat and no grading would be needed. Other items reviewed with the Commissioners <br />were the location of the fence in relation to the twenty foot right-of-way easement, <br />the fact that the property had been developed before the Town's incorporation and that <br />further subdivision of adjacent property had created the setback at variance with <br />the Town's requirements. <br />Commissioner Dochnahl inquired about whether the twenty foot right-of-way easement <br />was a public easement or a right-of-way easement under private ownership. Thereafter <br />the hearing was opened to the public discussion. <br />Christopher Smith Applicant, noted that the driveway had been described by deed as <br />a non-exclusive easement and that it belonged to the Marsh family. He responded to <br />Commissioners' questions by noting that the plans for his house were dated July 1955, <br />before the Town's incorporation, and that the location for the proposed addition was <br />the least obtrusive as far as the neighborhood was concerned. <br />The public hearing was closed, and the following motion passed: MOTION SECONDED AND <br />PASSED UNANIMOUSLY: It was moved by Commissioner Dochnahl and seconded by Commission- <br />er Rydell that the variance request for the Lands of Smith, File #VAR.5-80, be <br />recommended for approval, with the responses tothecriteria and the condition as <br />recommended in the staff report dated July 3, <br />0. <br />ADJOURNMENT: <br />There beinn_ no further new or old business, the meeting was adjourned at 7:15 p.m. <br />Respectfully submitted, <br />Ethel Hopkins <br />Secretary <br />
