AYES: Mayor Siegel and Councilmembers Dauber, Hubbard and Johnson <br />%1W NOES: Councilmember Casey <br />Casey stated for the record that she voted against this motion because she supported <br />the original contribution of $2,000. <br />5.2 Public/Private Roads <br />MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Hubbard <br />and passed unanimously to direct the City Manager to return to the Council with <br />resolutions for acceptance of the following private through streets: Briones Way, <br />Tepa Way and Camino Hermoso. <br />A specific issue of Ursula Road was raised as the single owner of the road wanted his <br />private road to be public. He was willing to pay for the improvements if any were <br />needed to the road. <br />Council discussed this issue noting that it was a policy question and they would <br />need to be consistent for all residents. There was the liability issue, the issue of clear <br />title and the possible need for improvements. Casey stated that it was the <br />responsibility of the Town to provide an adequate road system for the residents. <br />Most residents wanted the roads to be public and did not realize that their roads <br />were private. She did not believe residents should have to pay to bring the roads up <br />�w to Town standards and recommended that the residents be present when their road <br />was discussed. <br />MOTION SECONDED AND CARRIED: Moved by Dauber, seconded by Siegel and <br />passed unanimously to establish the following policy regarding public/private <br />roads: If there is dear title, a minimum of 40' right of way, the improvements are in <br />an acceptable condition and constructed to Town standards, and the residents want <br />it to be public, the Town shall accept the road as public. <br />6.
