He believed that by granting this <br /> extension, the Council would be giving implicit approval for the design of the <br /> house which, in his opinion, was inconsistent with the LaPaloma policy. Casey <br /> disagreed with not granting this extension. She did not believe the development <br /> area had changed and thought it unfair to not grant the extension and to ask the <br /> applicant to redesign. <br /> Luis Yanez, applicant, noted that when he applied for his site development permit <br /> in 1989 all the neighbors had been notified and all had concurred with the design of <br /> the house. He did not believe the ordinances had changed and that his project <br /> would be approved today. He further noted that this was his family's dream home <br /> and if he had to come back with a redesign it would cost him a lot of money. <br /> MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Tryon and <br /> passed by the following roll call vote to deny the request for extension of the <br /> expiration date of a site development permit for Lands of Yanez, 26242 Fremont <br /> Road; to request the applicant to work with staff on a redesign of the project; and to <br /> waive additional site development fees. <br /> AYES: Mayor Pro Tem Tryon and Councilmembers Johnson and Siegel <br /> NOES: Mayor Hubbard and Councilmember Casey <br /> 5. PRESENTATIONS FROM THE FLOOR <br /> Michael Westfall, President - Cedar Shake and Shingle Bureau, stated that he was in <br /> opposition to the Town requiring a Class B roof; he believed this was unnecessary <br /> and caused an increase in homeowners' insurance rates because of high replacement <br /> costs. He further noted that their main concern was to keep the roof covering in <br /> place and keep flying embers away and he believed a Class C roof was adequate in a <br /> brush area. Mr. Westfall further commented on the proposed draft advisory ballot <br /> on fire-retardant roofing. He strongly suggested amending the first sentences of <br /> paragraphs three and four to include the word 'test' before exposures. Mr. Westfall <br /> stated that this would more accurately reflect the wording in the current Uniform <br /> Building Code. <br /> 6. PUBLIC HEARINGS <br /> 7.
