van Tamelen stated that she removed this from the Consent Calendar because she had <br /> no idea what the cost would be and the issue of liability by the Town was raised. <br /> The Acting City Attorney stated that he did not believe the Town would be liable. In <br /> addition it was pointed out that the reimbursement policy adopted by the Council <br /> clearly stated what the expense would be, specifially: 'Reimbursement shall equal the <br /> round-trip economy class air fare, plus any airport fees at the destination. When two or <br /> more persons travel together, only one shall be reimbursed.' <br /> MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Johnson and <br /> passed unanimously to approve the request from Planning Commissioners Comiso <br /> and Pahl to take a private plane to the Planning Commissioners Conference in San <br /> Diego in March 1990. <br /> 4.7 Actions of the Planning Commission: approved the following: <br /> 4.7.1 Variance to 30' Sideyard Setback and Maximum Floor Area <br /> Requirements of the Zoning Code, Lands of Brown, 11470 <br /> Summit Wood Road <br /> van Tamelen removed this item from the Consent Calendar because she wanted to <br /> appeal the decision of the Planning Commission. She did not believe the findings of a <br /> variance were met to allow this request for a three-car garage and a turret even though <br /> repair of some earthquake damage was involved and she further noted that staff was <br /> not in favor of granting the variance. <br /> A discussion followed concerning the appropriateness of one Councilmember <br /> appealing a Planning Commission decision and not the entire Council apppealing it. It <br /> was noted that according to the Code any resident in the Town could appeal a decision. <br /> Casey commented that she did not think it was right that fees for filing an appeal were <br /> waived for Councilmembers. <br /> The Director of Public Works noted that the house had not been red-tagged after the <br /> earthquake but there was some structural repair that needed to be done. The Planning <br /> Director also commented there appeared to be some deadlines for filing insurance <br /> claims by the applicant. Siegel commented that this application went beyond <br /> earthquake repair. Tryon stated that she supported the decision to appeal this decision <br /> but was concerned about the safety issue and liability as related to the delay of <br /> March 7, 1990 <br /> 4 <br />
