PASSED BY CONSENSUS: To amend Section 12-2.306 to read: "The City Manager or his <br /> designee or the Site Development Committee may require up to five trees to be planted <br /> for each one removed." <br /> MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Johnson and <br /> passed unanimously to amend Section 12-2.401 to read: "Upon recommendation of the <br /> Environmental Design and Protection Committee and the Planning Commission and <br /> following a notice public hearing If the owner at the hearing in writing protests <br /> the designation or the plan of protection, it shall require a four-fifths vote of the City <br /> Council to override the protest." <br /> MOTION SECONDED AND CARRIED: Moved by van Tamelen, seconded by Tryon <br /> and passed unanimously to amend Section 12-2.402 by amending the third sentence to <br /> read: "If the owner is financially unable to comply with the Plan of Protection, the <br /> Town may provide the funds necessary to perform the work."; and by deleting the last <br /> sentence. <br /> PASSED BY CONSENSUS: To add Section 12-2.404 Heritage Tree Protection on Town <br /> 4111/ Lands. The Town will establish a Special Fund to maintain and protect heritage trees <br /> on Town lands. With the approval of the Town Council, a resident of the Town may <br /> adopt and dedicate a heritage tree located on public property upon making a donation <br /> to the special fund sufficient to provide for its protection and maintenance." <br /> PASSED BY CONSENSUS: To add Section 12-2.405 The Town Historian shall maintain <br /> records and pictures of heritage trees. <br /> MOTION FAILED DUE TO LACK OF A SECOND: Moved by Johnson and failed due to <br /> lack of a second to eliminate Section 12-2.501. <br /> PASSED BY CONSENSUS: To direct the City Attorney to reword Section 12-2.502 for <br /> clarification purposes. <br /> March 21, 1990 <br /> 8 <br />
