OIEW C. PRESENTATIONS FROM THE FLOOR: <br /> D. REPORT FROM THE PLANNING COMMISSION: <br /> Planning Commissioner Emling reported that the following items were <br /> discussed at the 3/23/88 Planning Commission Meeting in addition to <br /> those the Council had already concurred with on the above Consent <br /> Calendar: 1) Lands of Eyvazov, 11635 Dawson, new plans for new <br /> residence submitted at Commission meeting and denied; and 2) Planning <br /> Commission Meeting scheduled for 3 : 00 p.m. on Friday, April 8th to <br /> discuss San Antonio Hills (west) annexation. <br /> Tryon inquired about the fees for Lands of Eyvazov and asked that the <br /> minutes of the Council meeting at which this had been discussed be <br /> reviewed for clarification. <br /> E. PUBLIC HEARINGS: <br /> 1 . LANDS OF PENN, 12252 Menalto Drive, appeal of administra- <br /> tive decision concerning the fee structure and request for <br /> a reduction in the billing from $861. 65 to $350 . 00. <br /> Council had before them the staff report dated 4/6/88 which had been <br /> prepared by the City Manager. The report included an outline of the <br /> correspondence between Mr. and Mrs. Penn and the Town and also <br /> CIO included the recommendation that the Penns pay the geotechnical costs <br /> the Town had absorbed related to the review of their room addition and <br /> garage construction. As stated in the report, the Town ' s geotechnical <br /> policy was to refer to the Town Geologist, William Cotton, all permit <br /> requests for major additions and all major non-habitable structures <br /> proposed to be constructed on average slopes of 15% or greater. <br /> Mr. Penn, applicant, referred to the ongoing correspondence he had had <br /> with the Town on this matter and noted that Council had copies of said <br /> correspondence in their packets . He specifically referred to the $411 <br /> charge for a preliminary review of his project which, in his opinion, <br /> was premature and sent to Mr. Cotton ' s office for a report before it <br /> should have been. Mr. Penn noted that the City of Los Altos included <br /> these charges in their plan fees and the County of Santa Clara had a <br /> fixed charge of $350 . He also outlined the cost of preparing the <br /> reports and letters he had received from Mr. Cotton' s office and <br /> seriously questioned the amounts charged for these documents. <br /> William Cotton, Town Geologist, explained that although it was <br /> infrequent when their office found that a soils test was not necessary <br /> when reviewing a project, their review at that stage often provided an <br /> applicant with information which could save them time and money in the <br /> long run. The report focused attention on specific problems. Mr. <br /> Cotton further noted that he did not think it was proper to compare <br /> Los Altos and the County to the Town. The areas were very different <br /> and the County ' s review of such projects did not include field review. <br /> 41111, Mr. Cotton did not see that there was any step in the process which <br /> could be eliminated. <br /> 4- 4/6/88 <br />
