F. REPORT FROM THE PLANNING COMMISSION: <br /> Commissioner Stutz reported that the following items were discussed at <br /> the 5/27/87 Planning Commission Meeting: 1) Lands of Fremont Hills <br /> Country Club, File CUP #8010-76 , annual review of conditional use <br /> permit approved with condition concerning signs; 2) Lands of Westwind <br /> Farms , File CUP #8022-77 , annual review of conditional use permit <br /> continued to the fall to allow for review of landscaping by the Site <br /> Development Committee; 3) Lands of Carse, Altamont and Taaffe, request <br /> for approval of site development permit for new residence, swimming <br /> pool and decking and accessory structure - sent back for redesign; 4) <br /> Lands of Collinson, File VAR #5-86 , approved; 5) Lands of Summit, File <br /> VAR #11-87 , approved; and 6) Lands of Clement, File VAR #10-87 , <br /> approved. In addition, the Commission agreed to continue the current <br /> process of routing Site Development Permit reviews along with <br /> Variances and Conditional Use Permits to the full Planning Commission, <br /> with the comment that if at the public hearing there was a problem or <br /> concern, then the item could be continued at the Site Development <br /> Committee level . <br /> van Tamelen commented that she was concerned that the Planning <br /> Commission appeared to be approving variance requests in spite of <br /> recommendations of denial by the staff. van Tamelen questioned <br /> whether this was a change of philosophy on the part of the Commission. <br /> Commissioner Stutz was requested to convey van Tamelen' s concerns to <br /> the Commission. <br /> G. PUBLIC HEARING: <br /> 1 . LANDS OF LIN, FILE VAR #5-87, 11645 Dawson Drive, request <br /> to exceed the maximum development area and site development <br /> permit for construction of a swimming pool <br /> The City Planner referred to her staff report dated 5/28/87 which <br /> noted that the Planning Commission had referred this application to <br /> Council without taking any action. The report further included the <br /> following staff recommendation: that the Council adopt a motion to <br /> deny both the original and revised variance requests (original request <br /> to exceed maximum development area by 1, 602 square feet for a pool and <br /> revised request to exceed maximum development area by 922 square feet <br /> for a reduced swimming pool ) due to an inability to support the <br /> necessary findings . <br /> The report also included an explanation of the original application. <br /> The Lins had received approval for zoning and site development permits <br /> in 6/86 and a special land use permit in 7/86. The approved plans <br /> showed a pool in addition to the new residence and the applicant was <br /> requested to submit structural pool plans if they wished to receive <br /> approval for the pool . Had the Lins received a permit for the pool , <br /> they would have needed to obtain a building permit prior to 1/2/87 in <br /> 4- 6/3/87 <br />
