C. CONSENT CALENDAR (CONTINUED) : <br /> Item Removed: <br /> C. 3 .g) Resolution # declaring the intention of said Town to <br /> vacate and abandon portions of Burke Road and Sunset Way <br /> under the provisions of the ' Public Streets, Highways and <br /> Service Easements Vacation Law' , Section 8300, et seq. , of <br /> the Streets and Highways Code of California <br /> Dronkert requested clarification regarding this resolution setting a <br /> public hearing on the issue and the notification process . Staff noted <br /> that this resolution did set a public hearing on this issue for a time <br /> certain, specifically at the October 7, 1987 Council Meeting. By law <br /> it was required to advertise this hearing twice in a local newspaper, <br /> post at the three boxes in Town and post on the property under <br /> discussion. <br /> The City Manager noted that the resolution before Council needed to be <br /> modified to include retaining access for emergency vehicles and to <br /> include a water line easement. <br /> MOTION SECONDED AND CARRIED: Moved by Siegel , seconded by van Tamelen <br /> and passed unanimously to adopt Resolution #91-87 declaring the <br /> intention of said Town to vacate and abandon certain portions of Burke <br /> Road and Sunset Way under the provisions of the ' Public Streets , <br /> Highways and Service Easements Vacation Law' , Section 8300 , et seq. , <br /> of the Streets and Highways Code of California as amended to include <br /> access for emergency vehicles and water line easement. <br /> C. PRESENTATIONS FROM THE FLOOR: <br /> D. REPORT FROM THE PLANNING COMMISSION: <br /> Commissioner Stutz reported that the following issues were discussed <br /> at the 8/26/87 Planning Commission Meeting: 1) question raised from <br /> Site Development whether conditional use permits should be reviewed <br /> annually - decision made not to change the procedure; 2) proposed <br /> zoning ordinance amended regarding fences - sent to Council for public <br /> hearing; 3) Lands of Wickman - abandonment proceedings: fire easement <br /> connection and path right of way over easement recommended; and 4) <br /> discussion of Vidovich and Daiwa proposed projects. <br /> E. PUBLIC HEARING: <br /> 1. LANDS OF ZUBILLER, FILE VAR #7-86 , 11655 Jessica Lane, appeal of <br /> Planning Commission ' s denial of variance request to allow the <br /> retention of pillars constructed inconsistently with Town policy <br /> and construction of fence on the street side of the reference line, <br /> in excess of the allowed maximum height <br /> 11111, <br /> 3- 9/2/87 <br />
