E. PUBLIC HEARING: Lands of Zubiller (continued) : <br /> Lr <br /> Council had before them the Town Planner ' s staff report dated 8/27/87 <br /> which included the background on the application and the staff <br /> recommendation that the Council uphold the decision of the Planning <br /> Commission to deny the variance request. <br /> Mr . Tony Lagorio, applicant' s representative, explained that the <br /> pillars in place do not encroach into the right of way. He further <br /> commented on the slope of the yard, the height of the fence and noted <br /> that his client was agreeable to a wrought iron fence rather than a <br /> solid one. There were many other examples in the neighborhood of such <br /> 'monuments ' and Mr. Lagorio distributed a corrected set of <br /> measurements for the Council ' s information. <br /> Mr. Zubiller, applicant, commented that at the time he had attended <br /> two meetings on his application and at no time was there a discussion <br /> of the fence. He further noted that the set of plans he had received <br /> did not have a notation on them regarding the fence. <br /> MOTION SECONDED AND CARRIED: Moved by Dronkert, seconded by Siegel and <br /> passed by the following roll call vote to grant the variance request <br /> for Lands of Zubiller, 11655 Jessica Lane, to allow the retention of <br /> pillars and construction of a fence on the street side of the <br /> reference line based on the following findings : topographical <br /> circumstances particular to the property (slope to driveway from <br /> Ilir proposed fence line) ; practical difficulties of constructing fence in <br /> middle of slope; and the owner would be deprived of privileges enjoyed <br /> by other property owners in the vicinity and under an identical zoning <br /> classification. <br /> AYES: Mayor Tryon and Councilmembers Dronkert and Siegel <br /> NOES: Councilmembers Plummer and van Tamelen <br /> van Tamelen stated that certain permits were granted for this property <br /> in 1983 . The fence was not constructed in the approved location and <br /> she did not agree with granting a variance at this time. <br /> F . OLD BUSINESS : <br /> 1. Request from Organization of Western Towns for Town to join their <br /> organization <br /> Council had before them the City Manager ' s staff report dated 8/28/87 <br /> which noted that the central goal of the Organization of Western Towns <br /> was ' to expand the governing and management skills of small cities and <br /> other small town governments. . <br /> I� -4- 9/2/87 <br />
