SPECIAL ORDERS: Item l.c) IANDS OF BELUJCCI (continued): <br />The City Attorney rated that the following two decisions were before Council <br />concerning the Lairds of Bellucci: 1) whether to adopt the proposed Negative <br />Declaration or to order preparation of an Environmental Impact Report, and 2) <br />whether to uphold the Planning Commission's order to continue the application <br />for a Use Permit or to direct the Commission to complete its hearing on the <br />application and reach a decision. The City Attorney further stated that only <br />after a decision was made by the Planning Commission or the members fail to <br />decide the matter within a reasonable time could the Council consider an <br />appeal on the merits of the application. <br />Nancy Lytle referred to her staff report dated 2/15/85 which noted that since <br />the 1/23/85 Commission meeting, the administrative draft Environmental Impact <br />Report had been received from Earth Metrics Incorporated. This draft dooanent <br />addressed the recreation facility with a proposed membership of 1,750 and iden- <br />tified no significant traffic impacts nor significant increase in actual miss <br />levels. Based on the information available, staff referred the Council to the <br />original recommendations node in the 1/17/85 staff report, i.e. adopt a negative <br />declaration . <br />Mr. Paul Myers, Jr., applicant's attorney, gave a brief background of the Adobe <br />Creek Club and presented slides of the property. He noted that the issue before <br />the Council was adoption of a negative declaration for the application for a <br />recreation facility limited to 300 memberships. Mr. Myers further explained why <br />the applicant had filed two applications (one for a 1,750 membership and one for <br />a 300 membership). The larger membership application had required an Environmental <br />Impact Report, with completion of that application possibly running into late <br />1985. His client had filed an application for the 300 membership use permit so <br />that the marketing effort concerning the proposed recreation facility could begin <br />on a smaller level with possible future expansion to the 1,750 membership level. <br />Mr. Myers stated his opinion that the request was in conformance with the 'Town's <br />General Plan and reiterated that the proposed facility was definitely non-profit. <br />He also commented on the fact that since the Planning Commission meeting, a draft <br />EM was now available on the larger membership facility which indicated no signifi- <br />cant traffic impacts nor increase in actual noise levels. <br />The following residents addressed the Council in opposition to the proposed <br />recreation facility at Adobe Creek and supported the Planning Commission's <br />decisions to require an Environmental Impact Report on the application for a <br />300 membership use permit. The residents expressed their concerns regarding <br />the following issues: traffic, raise, flood plain, safety, run -conformance with <br />Town's philosophy on rural character and potential increase in police problems. <br />They also rated that they had not had an opportunity to review the draft EIR which <br />had recently been received by the Town on the larger nembership application. <br />SO <br />
