CITY COUNCIL MINUPFS - December 5, 1984 <br />D. SPECIAL ORDERS: <br />1. Public Hearings: <br />a) Request for Site Approval, IA`DS OF LEWIS, File SA #5-84 <br />The Staff Planner presented her report dated 11/29/84 concerning the Site <br />Approval for Lands of Lewis on Canario Way. Council discussed the proposed <br />staff codifications to the Planning Commission's approved Conditions of <br />Approval and also requested clarification of the proposed grading, the <br />possible abandonment of the easement and the potential for finding items <br />of archaeological significance on the property. <br />Jemes Foulk, a licant's ineer noted that he agreed with the staff's <br />rfications to the conditions and briefly cmuented on the grading and <br />easement issues. <br />Tan Barton, applicant's developer, consented that there was little likelihood <br />of finding any items of archaeological significance because the grading to be <br />done was quite minimal. <br />PASSED BY CONSENSUS: The following corrections and/or additions were approved <br />for the Lands of Levis Conditions of Approval: <br />Condition 1.B. to read as follows: 'The owner shall dedicate to the Town a <br />conservation easement along Deer Creek, following the same boundary as the <br />proposed storm drainage easement, however, separately described. Proposed <br />driveway and bridge can cross the conservation easement and the clearing of <br />minor scrub, particularly poison oak, as approved by the City Engineer will be <br />allowed in the conservation ease snt. ' <br />Condition 4.A. to read as follows: 'Applicant shall obtain encroachment permit <br />from the Irian and install Type IIA path along property line, within road right- <br />of-way, in accordance with Pathway Camdttee recordation dated July 6, 1984.' <br />Condition 6.A. to read as follows: 'Applicant shall enter into a cost sharing <br />agreement, precedent to Site Approval for construction of a fire hydrant on <br />Purissima Poad, as reccamended by the City Engineer in his mec, dated November 5, <br />1984. Installation of the hydrant shall be accomplished prior to issuance of <br />building permit, as reornended by the Los Altos Fire Department.' <br />Condition 6.E. to be added as follows: 'At the time of Site Development Committee <br />consideration, the grading plan approved for Site Development Permit shall not <br />allow grading in the septic tank drainfield area and the plan shall raise the pro- <br />posed building pad elevation above the 100 year flood plain elevation.' <br />Condition 6.B. the second sentence should read as follows: 'Should the Cammittee <br />decide to approve a crossing on Deer Creek, the design of the proposed crossing <br />shall be to the satisfaction of the Santa Clara Valley Water District, Los Altos <br />Fire Department, and the City Engineer and the existing easement shall be abandoned.' <br />Ma <br />PASSED BY CONSENSUS: <br />To change <br />allreferences from 'should' in the Conditions of <br />E <br />Approval to 'shall'. <br />Ma <br />
