CITY OJUNCIL MINOPEi - February 2, 1983 <br />A. ROLL CALL ADID PLEDGE OF ALLEGIANCE: 1. Matadero Creek Subdivision (continued): <br />C) Lot #5 <br />Jackye Wolfe, Fo:c & Carskadon, reported that the potential buyer for Lot #5 had <br />accepted the Council's counteroffer which was presented on January 25, 1983. <br />MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed unani- <br />nqusly by all members present to adopt Resolution #1524 accepting proposal and <br />ordering sale of real property, directing payment of real estate commission, auth- <br />orizing execution and delivery of deed, and accepting deed of trust and authorizing <br />recordation thereof concerning Lot 5, Tract No. 7187, Matadero Creek Subdivision. <br />d) Cash Requirements - Matadero Creek Subdivision <br />MOTION SECONDED AND CARRIED: Moved by Proft, seconded by Hillestad and passed unani- <br />mously by all members present to authorize the City Manager in conjunction with the <br />City Attorney to seek a formal tax exempt opinion from bond counsel and to explore <br />possible lending sources. <br />MOTION SBCONDED AND CARRIED: Moved by Allison, seconded by Perkins and passed by <br />the following roll call vote to continue Item F.2 - Report on Matadero Creek SUIT <br />division, CC&Rs - to the next Council meeting so that the proposed changes could be <br />considered by all Councilmenbers. <br />AYES: Mayor Perkins and Councilnembers Allison and Hillestad <br />NOES: Councilnenber Proft <br />ABSENT: Councilmenber van Tamelen <br />William Brooks attorney for Mr. James Viso, addressed the Council aryl expressed the <br />concerns of his client in the continuation of this matter. They were eager for an <br />early decision by Council concerning the CC&Rs. <br />2. Report on Storm Problems <br />The City Manager pointed out on a Town map the trouble spots which had resulted <br />from the nmst recent storm. It was further noted that sand and sandbags were <br />available for the residents of the Town. <br />The following representatives of the Santa Clara Valley Water District addressed <br />the Council explaining what their jurisdiction was in Town, where the right-of-ways <br />were located, and what maintenance program was being followed: Mr. Bill Carlsen, <br />nPci= rrvrrlinatia nivisinn Fnaineer: Mr. Dan Krieae, Operations Maintenance <br />Division Engineer. In particular the area near Rhus Ridge amu nnoay ECaa was ars- <br />cussed with emphasis on what improvements, if any, were made to the dam on Moody <br />Foad, who had responsibility for this area and what solutions could be suggested to <br />solve the flooding problem. The SC4WD urged residents to contact them regarding <br />problems in Town so they could work together towards successful solutions. It was <br />further agreed that the City Attorney and the City Manager would work together in <br />ocopi'ling a list of the areas in Town which were the Town's responsibility. <br />-2- <br />
