SPECIAL ORDERS: l.a) Lands of Matadero Creek (continued) <br />f6r The Planning Commission Representative explained to Council the three <br />rec m endations made by the Planning Commission and also addressed the <br />response of the planning Commission (stated in a letter dated 5/27/82 <br />to the Council) to the suggestions made by the City Manager. <br />Walter Babbitt, 27911 Via Ventana, questioned condition 7C regarding building <br />circles and setback rules. The city Manager responded that setback rules would <br />prevail and that height limitations would also remain a criteria. <br />Donald YouuxJ, 27665 Via Cerro Gordo, asked if the building circle included <br />stens su as pools, spas, etc. He was advised that the building circle was <br />only for the (rouse. <br />Frank Saul, 27977 Via Ventana, questioned the feasibility of someone purchasing <br />a lot with the requirement of having to go before Site Development. He supported <br />the City Manager's reoounendation of a pre-bid review. <br />Mrs Nagpal 1181 St Charles Street Los Altos, questioned some of the restric- <br />tions on the subdivision and asked if other subdivisions in Town were subject <br />to the same rules. She also asked for clarification of the pre-bid process and <br />its fairness to all potential bidders. The City Manager explained the Town's <br />code regarding all building and further explained the pre-bid process. <br />MOTION SEODNDED AMID CARRIED: Moved by Hillestad, seconded by van Tamelen and <br />passed unanimously to amend Condition 73 as per Exhibit A (maximum development <br />` area). <br />MOTION SECONDED AMID CARRIED: Moved by Hillestad, seconded by Allison and passed <br />unanimously to amend Condition 7C as per Exhibit B&C (maximum elevation of <br />structures) . <br />MOTION SECONDED AND CARRIED: Moved by PrOft, seconded by van Tamelen and passed <br />unanimously to revise the vehicular access for lots 7 and 10 and to amend the <br />Tentative and Final Maps per Exhibit D. <br />MOTION FAILED DDE TO LACK OF A SEO3ND: Moved by Hillestad to delete the following <br />sentence from Condition 7C: "In addition to the house orientation criteria above, <br />the house location shall be restricted to the building site circle as shown on <br />Exhibit #8 of the staff report unless the applicant can show to the Town that <br />the principles set forth in the CC&Rs will be better served by departure from this <br />rule. 11 <br />NOTION SECONDED AND CARRIED: Moved by van Tamelen, seconded by Proft and passed <br />by the following roll call vote to amend the last sentence of Condition 7C to read <br />as follows: "In addition to the house orientation criteria above, the house Loca- <br />tion shall be restricted to the building site circle as shown on Exhibit #8 of the <br />staff report unless the applicant can show to the Tuan through a preliminary review <br />by the Site Development Camuuttee that the principles set forth in the CC&Rs will <br />be tetter served by departure from this rule." <br />AYES: Mayor Perkins, Councilmembers Allison, Proft and van Tamelen <br />NOES: Councilwoman Hillestad <br />-4- <br />
