STAFF - REPORTS, CORRESPONDENCE AMID ANNOUNCEMENTS: 1. City Manager's Report: a) VANTRANS The City Manager recCUMended that Council adopt a Resolution requesting the Metropolitan Transportation Commission grant the allocation of funds to support the Town's participation in the Vantrans Program. This program provides trans- portation service to the senior citizens and the handicapped in Town. M7TION SECONDED AMID CARRIED: Moved by Perkins, seconded by Proft and passed unanimously by all members present to adopt Resolution #1364 authorizing the filing of a claim with the Metropolitan Transportation Commission for alloca- tion of transportation development act funds for fiscal year 1981-82 b) Santa Clara County Municipal Solid Waste Management Program The City Manager discussed the 6/24/81 report from the City of Mountain View which outlined their options regarding solid waste management. Mountain View was suggesting that they do not remain in the JPA Program. The City Manager recaanended to Council that they suggest Mountain View remain in the JPA and an atteWt be made to work out any present problems. Perkins asked the City Manager to prepare a report outlining the facts, ficures and options for the Town in this area. PASSED By CONSENSUS: To direct the City Manager to send a letter to the City of Mountain View reccmmending that they remain in the JPA. 2. SPECIAL ORDERS: 1. Request for Final Map Approval, LANDS OF ABRAHAMS, File FM #15-80 MOTION SECONDED ASID CARRIED: Moved by McReynolds, seconded by Proft and passed unanimously by all menbers present to adopt Resolution #1365 approving final parcel map and approving and authorizing execution of subdivision agreement. MOTION SECONDED AND CARRIED: Moved by Prof t, seconded by Perkins and passed unanimously by all members present to adopt Resolution #1366 approving and authorizing execution of a private road maintenance agreement between MunseY Development Corporation;G.K.W. Enterprises, Inc.; Ella M. McElvain; Doris Y. Abrahams, also known as Doris Yankauer Abrahams, also known as Doris Yankauer Mayer, also known as Doris Mayer Fortes; Robert C. Davis and Janice Diane Davis; and the City of the Town of Los Altos Hills. 2. Public Hearings: a) Resolution #_adopting an appropriations limit for the 1980-81 fiscal year. The City Manager explained that each year the Town would be required to adopt a Resolution establishing its appropriations limit for the following fiscal year pursuant to Article XIIIB of the California Constitution (Proposition 4, adopted on November 6, 1979). MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by McReynolds and passed unanimously by all members present to adopt Resolution #1367 adopting an approp- riations limit for the 1980-81 fiscal year. b) Resolution # adopting an appropriations limit for the 1981-82 fiscal year. MOTION SECONDED AMID CARRIED: Moved by Perkins, seconded by McReynolds and passed unanimously by all members present to adopt Resolution #1368 adopting an approp- riations limit for the 1981-82. c) Request for Tentative Map Approval, LANDS OF MATADM CREEK, File TM #1-81 NOTION SECONDED AND CARRED: Moved by Perkins, seconded by Proft and passed unanimously by all members present to adopt the Negative Declaration, LANDS OF MATADERO CREEK, File TM #1-81 The City Engineer briefly outlined his staff reports dated June 5, 1981, June 19, 1981 and June 25, 1981 and reported to Council that the Planning Cammission at its meeting of June 24, 1981 had recrn ended approval of the tentative map for the Lands of Matadero Creek subject to the conditions of approval. -3- CITY COUNCIL MRR)TES - July 1, 1981 E. SPECIAL ORDERS: Item 2.c) LANDS OF MATADERO CREEK (continued): Walt., Bahhitt. 27911 Via Ventana, Nick Ward, 27947 Via Ventan Council expressing the opinion that there should be less lots and more open space in the subdivision. Paul Reneau 13149 Byrd lane, further emphasized the importance of good planning and proper CC&Rs; the opportunity was at hand to have a model subdivision. PASSED BY CONSENSUS: To make the following corrections and/or additions a part of the Conditions of Approval: First paragraph amnded to read: ,The Planning Commission, at its meeting of June 24, 1981 recon ended approval of the Tentative Map dated "Revised June 17, 1981" for the above request, subject to the following conditions:" Condition 1.A. add the following: ". . .The owner shall dedicate an equestrian/ pedestrian easement, public utility easemnt and access easement for the Purissima Hills Water District over the right-of-way for Matadero Creek Lane and Matadero Creek Court." Condition I.C. add the following: " . .The emrgency access easement shall incorporate a bike, equestrian and pedestrian easemnt." Condition 1.E.6. amended to read: "Teporary grazing of animals is allowed ( unless such grazing pronotes excessive damage to vegetation or soil erosion." Condition 4.D. added: "The owner shall install a dual path along the amrgency access easamnt frau Page Mill Road to Matadero Creek Lane." Condition 7.C. first paragraph amended to read: "The maximum height of structures, landscape requirements, house orientation and other Site Development criteria contained in Exhibit #8, Site Development Map dated 6/5/81 and received 6/26/61, shall apply to each lot, a smrary of these requiremnts are listed below." MffI0N SECl7NDED AM cARRIM: Moved by Perkins, seconded by McReynolds and passed unanimously by all members present to approve the Tentative Map, LANDS OF MATADEJU CREEK, File TM #1-81, subject to conditions as recommended by the Planning Canmission and as amended by Council. d) Ordinance # amending Chapter 5 entitled "Zoning" of the Los Altos Hills Municipal Code by adding Sections 9-5.209, 9-5.212, 9-5.215, 9-5.226 and 9-5.227, and by amnding sections 9-5.210, 9-5.232, 9-5.502 9-5.504, and subsection (a) and the title of section 9-5.503 thereof, and by renumbering certain sections thereof. (SFMM READING). LOTION SECONDED AND CARRIED: Moved by Perkins, seconded by McReynolds and passed unanimously to waive further reading of Ordinance #268. -4- CITY COUNCIL MINUTES - July 1, 1981 ` E. SPECIAL ORDERS: Item 2.d) Ordinance #268 (continued): The City Engineer discussed both aspects of the proposed ordinance: building height and development area limitation. In response to an earlier request from Council, he referred to his staff report dated 6/25/81 which presented a sumnary and analysis of the issue of remodeling. The City Engineer additionally explained the zoning permit process which was being proposed to administer the proposed ordinances and other zoning regulations in the zoning chapter of the Municipal Code. Planning Cannissioner Lachenbruch, in response to a question concerning lot unit factors, explained that three perameters were involved: overall average acreage; overall average slope of property; and slope of building area. W. Sunset Drive and would affect, for example, Mr. Ayer Is property which had just earlier in the evening been given approval for site development. The City Engineer responded that it would be inappropriate to discuss this specific piece of property because staff had not had the opportunity to study the plans, etc. Council concurred that it was not the proper time to discuss Mr. Ayer's property as it related to the proposed ordinance. MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by McReynolds and passed unanimously by all members present to adopt Ordinance #268 mending Chapter 5 entitled "Zoning" of the Los Altos Hills Municipal Code by adding sections 9-5.209, 9-5.212, 9-5.215, 9-5.226 and 9-5.227, and by mending sections 9-5.210, 9-5.232, 9-5.502, 9-5.504, and subsection (a) and the title of section 9-5.503 thereof, and by renumbering certain sections thereof. e) Ordinance # mending Chapter 5 entitled "zoning" of the Los Altos Hills Municipal Code by adding sections 9-5.215(1) and 9-5.231, and by mending subsection (b) of Section 9-5.503, respectively, con- cerning walls and fences (SECOND READING) - continued from 3/16/81 meeting. hMION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed unanimously by all members present to waive further reading of Ordinance #267. The City Engineer noted that this discussion had been continued from 3/16/81 in order that the matter of enforcement could be addressed. He referred to his staff report of 6/25/81 in which he stated two possible approaches: l) the establishment of a permit specifically for fences; or 2) the establishment of a zoning permit that could be applied to all kinds of structures. Council agreed that that the ordinance could be adopted and the issue of enforce- ment could be decided upon at a later date. rUTION SECONDED AND CARRIED: Moved by proft, seconded by Perkins and passed unanimously by all members present to adopt Ordinance#267 amending Chapter 5 entitled "zoning" of the Los Altos Hills Municipal Code by adding sections 9-5.215(1) and 9-5.231, and by amending subsection (b) of Section 9-5.503, respectively, concerning walls and fences. CITY COUNCII, MINUTES - July 1, 1981 F. GENERAL ORDERS AMID UNFINISHED BUSINESS: G. NEW BUSINESS 1. Request from the Los Altos Fire Department for Council authorization to remove fire hazards on certain properties within the Town. MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed unanimously by all members present to approve reouest and authorize the City Manager to abate fire hazards. 2. SB1960 New State Law related to Manufactured Housing PASSED BY CONSENSUS: Council directed the Planning Comaission to continue their careful review and study of this important issue and to report back to the Council when their findings were complete. 3. Ordinance # amending Title 8 entitled "Building Regulations" of the Los Altos Hills Municipal Cade by adding thereto Chapter 8 entitled "Fire Code" to adopt by reference the 1979 edition of the uniform fire code, including certain appendices, and amenchents thereto. MOTION SECONDED AND CARRIED: Moved by Perkins, seconded by Proft and passed unanimously by all manbers present to waive further reading of Ordinance # MOTION SECONDED AMID CARRIED: Moved by McReynolds, seconded by Proft and passed unanimously by all members present to introduce Ordinance #269 amending Title 8 entitled 'Building Regulations" of the Los Altos Hills Municipal Code by adding thereto Chapter 8 entitled "Fire Code" to adopt by reference the 1979 edition of the uniform fire code, including certain appendices, and amenchments thereto. NOTION SECONDED AMID GARBLED: Moved by Proft, seconded by McReynolds and passed unanimously by all members present to adopt Resolution #1369 setting the time and place of public hearing on the proposed adoption of a certain uniform fire code, including certain appendices, and amencLrents thereto.
