6 J <br />CITY COUNCIL 14INUI-ES - October 30, 1980 <br />D. 3.a) Lards of Lee, Site Developuent Permit No. 4775 (continued): <br />Councilme hers continued their discussion of this permit including the <br />following factors: construction in Swale; not in accordance with the General <br />Plan; plans had significant aaaunts of cut and fill which exceeded the guide- <br />lines of the tennis court policy. <br />Anthony Lagorio applicant's attorroV, supported the applicant's request <br />for a site developnent pe=t and rote, that it hx3 been approved by the <br />Planning Crnmission. He further po tented on the procedure concerning the <br />appeal of this approval and also asked if the plan as proposed was in violation <br />of the Town's ordinances. <br />Peter Shaw, landscape architect, presented the landscape plans to Council <br />with particular emphasis on the drainage system and Swale. He noted that he <br />agreed in concept with the General Plan but believed this property needed to <br />be looked at specifically. <br />Ven Lee, applicant, noted that the ruralness of the property was also impor- <br />tant to him. When he had Purchased the property, all of the vegetation had <br />been re eved by the previous owner. The swale was eroding and net natural <br />at all as it stood. He therefore had brought in a landscape architect to <br />improve the situation. Mr. Lee further manented that if possible he would <br />confer with the Town's staff in the hope of correcting certain problems and <br />arriving at acceptable plans. <br />Councilmembers further noted that the proposed landscaping did net pose the <br />problem. The tennis court was the issue and it was possible that this could <br />be worked out to everyone's satisfaction. <br />MDrION SEOONDED AND CARRIED: Moved by McReynolds, seconded by Perkins and <br />passed unanimously to refer Tandy of Lee, Site Development Permit No. 4775 <br />back to the staff and to continue this item at the December 3, 1980 City <br />Council Meeting. <br />E.
