MINUTES OF A REGULAR MEETING
Wednesday, May 2, 1979

Mayor Thomas P. McReynolds called the Regular Meeting of the City Council to order at
7:44 p.m. in the Council Chambers of Town Hall.
A. ROLL CALL & PLEDGE OF ALLEGIANCE:
Present: Mayor McReynolds, Councilmembers Hillestad, Nystrom, Perkins and Proft.
Absent: None.
Staff: City Manager Robert Crowe, City Attorney Frank Gillio, City Engineer John
Carlson, Commissioner Joseph Dochnahl for the Planning Commission and Deputy
City Clerk Susan Buttler.
B. CONSENT CALENDAR:
The City Manager requested removal of Item B.4.c)for continuation to the next meeting
and Councilman Perkins asked for removal of Item B.1. for separate consideration.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilman Perkins
and carried unanimously to continue the following to the next regular meeting:
4. Resolutions for Adoption:
c) Resolution # accepting certain improvements, Lands of Costello Subdivision,
Tract #6289.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilman Nystrom
and passed unanimously to approve the balance of the Consent Calendar, specifically:
2. Approval of Warrants: $21,533.47.
3. Actions of the Variance & Permit Commission - recommended granting of the following:
a) LANDS OF JAISWAL, File VAR #7057-79.
4. Resolutions for Adoption:
a) Resolution #1197 accepting certain improvements, Hayward Acres Subdivision,
Tract #6097.
b) Resolution #1198 ordering the performance of certain work, 1979 Street
Resurfacing Project.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilman Proft
and passed unanimously to amend the April 18, 1979 Minutes, Page 2, 4th Paragraph, 2nd
sentence to read: He then requested that SkkAAf��fµprepare a detailed procedure for pro-
cessing a subarea plan and includingfcEbmKfe General Plan. Copies are to be sent to
the Planning Commission and City Council, and signed by the City Manager and City Attorney.
The Chaparral Way subarea study could prove to be a model for other areas in the Town.

C. SPECIAL REPORTS:

2. Reports of Ad Hoc Committees:
Councilwoman Hillestad suggested that a letter of commendation and thank you be sent
to the Chairman and all those who worked on the Mayor's Safety Awareness Run.
3. Reports from the Planning Commission: None
4. Presentations from the Floor:
Mrs. Couperus, Friends of Westwind, told of the details for the upcoming horse show on
Sunday to benefit the Cooperative and introduced Laura Flett with a slide presentation
on the "Riding for the Handicapped" program.
Following the fifteen minute program, Councilmembers heartily commended the Friends of
Westwind for their hard work on this worthwhile endeavor.
D. STAFF - REPORTS, CORRESPONDENCE & ANNOUNCEMENTS:
1. City Manager:
a) Report on Library Improvements.
The City Manager advised that there were funds available for the Town to participate in
these improvements. Councilmembers concurred on the worthiness of the library in general,
however, Councilman Perkins cited his concerns as to realizing the best use of monies
donated in light of Prop. 13 effects and Councilman Proft stated his objections to expen-
ditures for outside improvements rather than for staffing and materials requirements.
MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by Councilwoman
Hillestad and passed by the following roll call vote to appropriate $2,000 from the
General Fund Unappropriated Fund Balance for a contribution to the Los Altos Library
improvements.
2. Executive Session - Personnel
Council adjourned at 8:20 p.m. to Executive Session and reconvened at 9:15 p.m.
E. SPECIAL ORDERS:
1. Ordinance #251 amending Section 9-4.205, and Subsection (c) of Section 9-4.604,
respectively, of Chapter 4 entitled "Subdivisions" of Title 9 entitled "Planning
and Zoning" of the Los Altos Hills Municipal Code. (SECOND READING)
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilman Nystrom
and passed unanimously to waive further reading of Ordinance #251.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilman Proft
and carried unanimously to adopt Ordinance #251 by title.
2. Public Hearings:
a) Request for Tentative Map Approval, LANDS OF LOW, File TM #2088-78.
The City Engineer provided information for consideration of the Negative Declaration,
responding to questions concerning mitigating measures that these were incorporated into
TW the Conditions of Approval.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilwoman
Hillestad and passed unanimously to adopt a Negative Declaration, LANDS OF LOW, File
TM #2088-78.

After a brief review by the City Engineer, Councilmembers cited their concerns as to
specific mitigating measures for noise due to the proximity to IS280, landscaping re-
quirements for aesthetic qualities, the absence of slope classification accompanying
the revised Tentative Map before them and a motion (subsequently withdrawn) to continue
this matter in order to have all information available for a thorough review.
Mr. Nowack, Applicant's Engineer, spoke for the revised driveway plan which now followed
the contours, the proposed house design and that slope classification remained the same,
thus not requiring new maps.
Mr. Low, Applicant, offered his concurrence to access across his property for the adjacent
Love property and spoke for the careful development of his subdivision as he intends to
go on living there.
Thereafter, a motion was made, seconded and subsequently withdrawn to provide a condition
directing that the Final Map show the fault line and 25' residential setback zone.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilman Perkins
and passed unanimously to add as new Condition 9.E: Driveway access easement shall be
provided for the Lands of Love in the event that B.S.A. #6105-77 is approved.
MOTION SECONDED AND CARRIED: Moved by Mayor McReynolds, seconded by Councilman Perkins
and carried by the following roll call vote to add as new Condition 9.F: Type II founda-
tions will be required on Parcels 1 and 3, and so designated on the Final Map.
AYES: Mayor McReynolds, Councilmembers Hillestad, Nystrom and Perkins.
NOES: Councilman Proft.
MOTION SECONDED AND CARRIED: Moved by Mayor McReynolds, seconded by Councilman Perkins
and passed unanimously to amend Condition 9.0 to read: Each residence shall be designed
in a manner that the noise level within the residence shall not exceed an annual CNEL
of 45dba, as determined by a qualified consultant selected by the owner and approved by
the Town. No final inspection of any residence shall be approved until the interior
noise level does not exceed an annual CNEL of 45dba.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded
and carried by the following roll call vote to add as new Condition
for Parcels 1 and 3 shall not be issued unless demonstrated to be in
Scenic Highways Element of the Los Altos Hills General Plan.
AYES: Mayor McReynolds, Councilmembers Perkins and Proft.
NOES: Councilmembers Hillestad and Nystrom.

and passed unanimously that the Tentative Map, LANDS OF LOW, File TM #2088-78, be revised
to show slope classification.
MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Councilman
Nystrom and carried unanimously to approve the Tentative Map, LANDS OF LOW, File
TM #2088-78, subject to conditions as recommended by the Planning Commission and, as
amended above.
b) Request for Building Site Approval, LANDS OF LOVE, File B.S.A. #6105-77.
The City Attorney first advised as to the parliamentary procedure to follow with the
LV motion on the floor to approve the above request as well as motions that might be made
to amend, delete or add conditions to the proposed approval.

Councilman Proft then stated his objections to soils and seismic tests and information,
especially in the area where it was proposed to build the house. He made a motion which
was seconded and subsequently withdrawn to require additional soils and seismic reports.
Mr. Nowack, Applicant's Engineer, spoke for the completeness of the Cleary and Associates
Report of August 8, 1978.
Dr. Artuzi, Geologist, cited his confusion with the linking of sails and geology re-
quirements and answered Mayor McReynolds' questions as to stability of the area in
question and that there was lack of clear evidence as to actual fault placement.
Mr. Barton, Appliea cant's Builder, told of test borings and trenching which had been com-
pleted in the arof the house placement.
Councilmembers concurred as to the adequacy of this information, thus initiating the motion
withdrawal.
MOTION SECONDED AND CARRIED: Moved by Councilman Nystrom, seconded by Mayor McReynolds
and passed unanimously to amend Condition 6.A to read: The residence shall be designed
in a manner that the noise level within the residence shall not exceed an annual CNEL of
45 dba, as determined by a qualified consultant selected by the owner and approved by the
Town. No final inspection of any residence shall be approved until the interior noise
level does not exceed an annual CNEL of 45dba.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Mayor McReynolds and
carried unanimously to add as new Condition 6.E: A drainage plan for the entire site shall
` be submitted to the Town for approval prior to Site Development Committee meeting.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Mayor McReynolds and
passed unanimously to add as new Condition 6.F: Building permits shall not be issued
unless demonstrated to be in conformance with the Scenic Highways Element of the Los
Altos Hills General Plan.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Mayor McReynolds and
carried unanimously to amend Condition 6.B to read: Prior to the issuance of building
permits, a driveway access easement shall be vested in the owner of this property.
MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilman Nystrom
and passed by the following roll call vote to approve Building Site Approval, LANDS OF
LOVE, File B.S.A. #6105-77 subject to conditions as recommended by the Planning Commission
and as amended above.
F. GENERAL ORDERS & UNFINISHED BUSINESS:
1. Request from Wm. Alhouse for house re -location.
The City Manager provided a brief background on xhe permit issued previously to remove
from Town the house on Fremont and the request before Council now to locate this house
on Mr. Alhouse's property.
Mr. Alhouse, Applicant, reiterated his original intent to re -locate an historical house
and water tower onto his property, his subsequent problems with this proposal and his
current wish to obtain the house available on Fremont.
V MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilwoman
Hillestad and passed by the following roll call vote to amend the permit granted to G.
Snedigar to allow the house at 26052 Fremont Road to be moved to a location within the
Town, A.P.N. #175-21-001 and the house is to be sited within 60 days or removed from Town.
AYES: Mayor McReynolds, Councilmembers Hillestad and Perkins.
NOES: Councilmembers Nystrom and Proft.

LL 2. Request for relocation of overhead utility line, Tract #6355.
Mr. Lambert, Applicant, stated the original condition to underground was prompted by
the existing utility line over the proposed building site, that costs for re-routing
overhead wereestimated at $7,000 and undergrounding was exhorbitantly estimated at
$12-14,000. He asked for Council relief from this undergrounding stipulation as all
efforts had been made to resolve this issue.
Councilmembers discussed their efforts to provide undergrounding within the Town
at time of new subdivision whenever possible and their concurrence as to the expenses
involved in this case which presented a hardship.
MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by Councilman Nystrom
and carried by the following roll call vote to grant the request for relocation of over-
head utility line, Tract #6355.
AYES: Mayor McReynolds, Councilmembers Hillestad, Nystrom and Perkins.
NOES: Councilman Proft.
3. Request for extension of time for completion of certain improvements, Tract #6209
The City Attorney addressed the Applicant's letter of request, advising that promises
to clear the area of debris had been made by the previous owner and this ongoing problem
needed to be resolved as expeditiously as possible.
Mr. Lambert, Applicant, objected to being held responsible for promises made by the
prior owner and answered Council questions as to time estimates for the separate items
of concern.
4 MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Councilman
Perkins to direct the City Manager to correspond with the Applicant authorizing time
extensions as follows: (1) Installations of monuments on Moody Road to be completed in
two weeks, May 16, 1979; (2) Removal of debris along the top of the creek bank and
around the surface of the property to be completed in thirty days, June 1, 1979• (3)
Removal of debris in the creek bottom to be completed by August 31, 1979; and, (4) The
wading pool on Lot 8 to be removed within thirty days, June 1, 1979.
4. Request for resolve of trespassing problems from A.C. Kramer, Tract #5762.
PASSED BY CONSENSUS: That the Council correspond with Dr. Kramer as to methods of
correcting these problems and that Staff set up a meeting with the Developer's Engineer
and Dr. Kramer to explore the feasibility of a gate installation.
G. NEW BUSINESS:
1. City Council appointments to City Selection Committee and Inter -governmental Council.
PASSED BY CONSENSUS: To appoint the Mayor & Mayor Pro Tem to the City Selection Com-
mittee and for continuance of the two year appointment of Councilwoman Hillestad to
Inter -governmental Council.
Mayor McReynolds advised of the Los Altos School Board considerations of closing the
only public elementary school in Los Altos Hills (Bullis) and Councilmembers cited
their frustrations and objections to this proposal as well as the urgent need to make
the Town's feelings evident to the Board.
L, MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by Councilman Perkins
and passed unanimously to adopt Resolution #1196 regarding the proposed closing of a
public elementary school within the Town limits and citing the Council's objections.

MOTION SECONDED AND CARRIED: Moved by Councilwoman Hillestad, seconded by Councilman
Nystrom and carried unanimously to adopt Resolution #1195 awarding an honorary degree
to Daryl D. Fazekas and wishing him well in his future endeavors.
H. ADJOURNMENT:
There being no further new or old business to discuss, the City Council adjourned at
12:01 a.m..
