Presentations from the Floor: <br />Mrs. Carico, O'Keefe Lane, asked if Council and Staff were aware of a bill pending <br />action at the State level which could mandate low cost housing In all communities. <br />Mayor Brown and Councilman McReynolds agreed that this might pose a serious threat, <br />requested that any Information on this legislation be put before the Legislative <br />Review Committee for study and stressed that local government strength would come <br />from citizen awareness and Involvement. <br />D. STAFF - REPORTS, CORRESPONDENCE & ANNOUNCEMENTS: <br />None <br />E. SPECIAL ORDERS: <br />I. Public Hearing: <br />( a) Request for Tentative Map Approval, LANDS OF HUTCHINS, File TM #2053-77: <br />MOTION SECONDED AND CARRIED: Following introduction by the City Manager, It was <br />moved by Councilman Cheney, seconded by Councilwoman Hillestad and passed unan- <br />imously to adopt a Negative Declaration for LANDS OF HUTCHINS, File TM #2053-77. <br />Councilman Proft questioned the distance of the barn from the property line and <br />the Engineer/Planner Mr. Mark 1, outlined the new field survey that had been made <br />which placed the barn well within the proper setbacks. <br />MOTION SECONDED AND CARRIED: It was moved by Councilman McReynolds, seconded by <br />Councilman Cheney and carried unanimously to delete Condition 12-(a), specifically: <br />The Town shall determine, if possible, when the barn at the southwest corner of <br />Parcel "2" was constructed. At the time the parcel is field -surveyed for the pre- <br />paration of the parcel map, the Town shall, by field Investigation, determine the <br />actual setback of the barn from the nearest external boundary and report the findings <br />to the Planning Commission prior to the submittal of the Parcel Map. <br />Discussion followed on the chain link fence existing on the property, the roadway <br />dedication requested from the Applicant and geological review that had been conducted <br />on the land In question. Determination of Altamont as an arterial road precluded the <br />thirty foot dedication from being excessive, seismic setback zones for buildings had <br />been included In response to geological hazards and the fence question was resolved <br />with the following amendment (included within the motion for Tentative Map approval). <br />MOTION SECONDED AND CARRIED: Moved by Councilman McReynolds, seconded by Councilwoman <br />Hillestad and passed unanimously to approve LANDS OF HUTCHINS, File TM #2053-77 sub- <br />ject to conditions as recommended by the Planning Commission, as amended by Council <br />and, with this change to the last sentence of Condition 16: Fence removal shall be <br />accomplished prior to the filing of the Final Map or a bond of sufficient amount to <br />guarantee future removal shall be posted with the Town. <br />-2- <br />
