Resolutions for Adoption: d) Resolution 1095 approving completion of the 1977 Street Resurfacing Project and authorizing final payment. C. SPECIAL REPORTS I. Reports of Standing Committees: None 2. Presentations from the Floor: Mrs. Carico, O'Keefe Lane, asked if Council and Staff were aware of a bill pending action at the State level which could mandate low cost housing In all communities. Mayor Brown and Councilman McReynolds agreed that this might pose a serious threat, requested that any Information on this legislation be put before the Legislative Review Committee for study and stressed that local government strength would come from citizen awareness and Involvement. D. STAFF - REPORTS, CORRESPONDENCE & ANNOUNCEMENTS: None E. SPECIAL ORDERS: I. Public Hearing: ( a) Request for Tentative Map Approval, LANDS OF HUTCHINS, File TM #2053-77: MOTION SECONDED AND CARRIED: Following introduction by the City Manager, It was moved by Councilman Cheney, seconded by Councilwoman Hillestad and passed unan- imously to adopt a Negative Declaration for LANDS OF HUTCHINS, File TM #2053-77. Councilman Proft questioned the distance of the barn from the property line and the Engineer/Planner Mr. Mark 1, outlined the new field survey that had been made which placed the barn well within the proper setbacks. MOTION SECONDED AND CARRIED: It was moved by Councilman McReynolds, seconded by Councilman Cheney and carried unanimously to delete Condition 12-(a), specifically: The Town shall determine, if possible, when the barn at the southwest corner of Parcel "2" was constructed. At the time the parcel is field -surveyed for the pre- paration of the parcel map, the Town shall, by field Investigation, determine the actual setback of the barn from the nearest external boundary and report the findings to the Planning Commission prior to the submittal of the Parcel Map. Discussion followed on the chain link fence existing on the property, the roadway dedication requested from the Applicant and geological review that had been conducted on the land In question. Determination of Altamont as an arterial road precluded the thirty foot dedication from being excessive, seismic setback zones for buildings had been included In response to geological hazards and the fence question was resolved with the following amendment (included within the motion for Tentative Map approval). MOTION SECONDED AND CARRIED: Moved by Councilman McReynolds, seconded by Councilwoman Hillestad and passed unanimously to approve LANDS OF HUTCHINS, File TM #2053-77 sub- ject to conditions as recommended by the Planning Commission, as amended by Council and, with this change to the last sentence of Condition 16: Fence removal shall be accomplished prior to the filing of the Final Map or a bond of sufficient amount to guarantee future removal shall be posted with the Town. -2-
