Public Hearings: (Continued) <br />MOTION SECONDED AND CARRIED: Moved by Councilman Perkins, seconded by <br />Councilman Proft and passed by the following roll call vote to approve <br />the first reading of Ordinance #246. <br />AYES: Mayor Hillestad, Councilmembers McReynolds, Nystrom, Perkins <br />and Proft. <br />NOES: None. <br />b) Request for Tentative Map Approval, LANDS OF HORTON, File <br />TM #2066-77, 6 Lots. <br />Continued at the request of the Applicant. <br />F. GENERAL ORDERS & UNFINISHED BUSINESS: <br />1. Request for time extension, LANDS OF BURKE, File B.S.A. #6030-74. <br />The City Attorney provided background on this Building Site Approval <br />Request which had passed the one year period for completion of conditions <br />and was currently in litigation. He advised Council to table the matter <br />pending the results of the court action. Councilman McReynolds questioned <br />the implied granting of additional time that this action might entail and <br />was told by the City Manager that administrative action of notifying the <br />Applicant of revocation had already taken place. <br />MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by <br />(61 Councilman Perkins and carried unanimously to table the Request for time <br />extension, LANDS OF BURKE, File B.S.A. #6030-74. <br />2. J. Crosby Soils Report, Saddle Mountain Estates. <br />Councilman Perkins asked that the City Engineer review the Winterization <br />Agreement between the Town and HAS Homes and the progress to date. <br />The City Engineer summarized as follows: (1) Hydroseeding has been com- <br />pleted, however, all areas have not germinated; (2) The storm drain has <br />been installed with the exception of one headwall; and, (3) Erosion con- <br />trol, sandbagging, etc., has not been initiated. <br />Discussion followed on the need to maintain a log of events as well as <br />when plans are requested and received by the Town. Councilmembers ex- <br />pressed concern as to the slow progression in the completion of all of <br />the Agreement items. <br />MOTION SECONDED AND CARRIED: Moved by Councilman Proft, seconded by <br />Councilman Nystrom and passed unanimously to direct Staff to set up a <br />time schedule of fifteen working days from December 21, 1978, for com- <br />pletion of the remaining items on the Winterization Agreement, that areas <br />where hydroseeding has not germinated be re -done and that consideration <br />of weather constraints be observed. This time schedule is to be forwarded <br />to the developer and, if the items are not completed to the satisfaction <br />of the City Engineer, the Town will cause completion by filing against the <br />( Improvement Bond for funding to cover all costs. <br />♦+ Mr. Stern, HAS Homes, stated that the timing on the hydroseeding had re- <br />sulted in the poor germination, changes on storm drain design were cur- <br />rently being worked out with the City Engineer, there were problems in <br />obtaining approved plans and erosion control changes were still under <br />discussion with the Town. <br />-4- <br />
