Council so agreed. <br />3. Actions of Variance & Permit Commission: <br />Request for Building Site Approval with Variances, LANDS OF SUIDZINSK.I, <br />File Nos. BSA 6043-75; Var. 7025-76; Var. 7026-76: Recommended approval <br />subject to conditions: <br />Town Planner Ken Pastrof explained that the subject property required four <br />separate pieces of legislation in order to bring it into conformance with the <br />Municipal Code: three which were before Council this evening, and a request <br />for a Conditional Use Permit which would be considered by the Pizreina <br />Commission at their next meeting. In response to Councilwoman H liestad as <br />to how this property could be brought into conformance under the Town's <br />zoning regulations, Mr. Pastrof cited 9-5.703 (k) of the Code, which allowed <br />the existence of a secondary dwelling without kitchen facilities unless the <br />prepew+,y were of sufficient size to provide the area for two lots, in which <br />Casa, the restrictions could be deleted at the discretion of h_ legislative <br />bodies. <br />11hen asked by the Mayor why Staff had not taken steps to bring this non- <br />confornring use into conformance, both Mr. Pastrof and Mr. Crowe responded <br />that the owner of the property had already taken steps to bring his property <br />into conformance, and while his petitions were pending before Council, it <br />would not be appropriate for the Town to initiate abatement proceedings. <br />City Attorney Frank Gillio addressed Council concerning the uses allowed under <br />the zoning ordinances with the granting of a Use Permit by Council. After <br />further discussion, Councilman Grabowski moved, seconded by Councilwoman <br />Hillestad to defer action on this matter until the next Council meeting when <br />the recommendations of the Planning Commission on the request for a Con- <br />ditional Use Permit could be considered by Ceuncil at the same time. Motion <br />carried unanimously by roll call vota. <br />4 b) !ANDS OF DICKINSON (formerly Altamont Knolls Stahles) - request for <br />Conditional Use Permit, File 8CU?8O11-76: Planning Commission <br />recommended approval subject to conditions as modified. <br />Councilman Proft noted that two requests for Cord+t.ional Use Permits were <br />before Ccuricil this evening, and his concern was that the Town be consistent <br />in the requirements for all such requests. Pertaining to the Lands of <br />Dickinson, he noted a discrepancy of the plot Plan map submitted, and also <br />express'd concern for adequate parking on theproperty. He noted additionally <br />the presence of a secondary dwelling and questioned its use. <br />-2- <br />
