CITY COUNCIL <br />TOWN OF LOS ALTOS HILLS <br />MINUTES OF A SPECIAL MEETING <br />April 26, 1972 <br />REEL 42 Side 2 Track 2 00-30 <br />Mayor Leslie A. Helgesson convened this special meeting at 7:48 P.H. at <br />Los Altos Hills Town Hall, with the following members answering roll <br />call. Present: Councilmen Davey, Kubby, Miller, Mayor Helgesson. <br />Absent: Councilman Grabowski. <br />Mayor Helgesson announced to the approximate 100 citizens that had <br />turned out, that he had called this special meeting in accordance with <br />the Town's Municipal code for the purpose of a special litigation <br />session, regarding the pending suit against the Town, that resulted <br />from the formation of Sewer Assessment District #9. Prior to adjourn- <br />ing to the Litigation Session at 7:50 P.M., the Mayor noted that as the <br />agenda indicated, it was the Council's intent to reconvene following <br />this closed meeting to consider the Town's sewer policy (Resolution <br />No. 458). <br />Upon reconvening at 5:55 P.M., Mayor Helgesson reported that the <br />Council had met with the Town's attorney J. J. Lynch to discuss pos- <br />sible areas of agreement in the suit: Mr. Lynch had then met with Mr. <br />Michael Di Leonardo, Attorney for the plaintiffs, to determine any <br />areae of agreement; and then the Council had met jointly with both <br />attorneys. The Mayor stated that "the Council had found no areas of <br />agreement on which we can agree as to the disposition of the suit, 90 <br />we feel any further discussion at the Council level or between the <br />audience and the Council would not be pertinent to our business to- <br />night." Also he noted that Councilman Grabowski who was in Sacramento <br />attending the League of California Cities Legislative Conference, had <br />requested and Council concurred that they would not take any action in <br />regards to the Town's Sewer Policy tonight. <br />Since several residents had indicated their displeasure at calling a <br />Special Meeting on short notice (32 hours) to cnnsider a controversial <br />issue, Mayor Helgesson recognized Councilman Miller who then read the <br />following applicable paragraph from the Municipal Code regarding <br />Special Meetings. <br />TITLE 2. ADMINISTRATION <br />Sec. 2-1.102 Special Meetings. <br />Special meetings may be called at any time by the Mayor, <br />or by four (4) members of the Council, by delivering personally <br />or by mail written notice to each councilman and to each <br />local newspaper of general circulation and radio and televi- <br />sion station requesting notice in writing. Such notice shall <br />be delivered personally or by mail at least twenty-four (24) <br />hours before the time of such meeting as specified in the <br />notice. The call and notice shall specify the time and place <br />of the special meeting and the business to be transacted. <br />No other business shall be considered at such meetings. <br />Such written notice may be dispensed with as to any Councilman <br />who, at or prior to the time the meeting convenes, files <br />with the City Clerk a written waiver of notice. Such waiver <br />may be given by telegram. Such written notice may also be <br />dispensed with as to any Councilman who is actually present <br />at the meeting at the time it convenes.
